View Full Version : Impact of lower wage on GC

My PD is on Aug 2007, but I missed to apply I-485 due to some troubles and waiting for my PD again. DOL approved wage for the new position (in GC) is double the wage I am getting now on H1B (which is a lower position). My employer had no problem with that until recently.

Recently my employer suffered from a major financial problem and board has brought a new CEO whose primary focus is to reduce the cost. I do not think they are interested/in a position to pay me with that wage in future (after my I-485 approval).

With the situation above, I have the following questions:

Will it impose a problem filing I-485 while time arrives?
Assuming I get approval on I-485, but employer refuses to pay the DOL rate; what all options do I have?

I have searched for a similar thread before posting, but sorry if I missed any.

There is no hard & fast rule on this...But if you go by the book...Once GC is approved Beneficiary should work in the same position/same pay/same duties as listed on PERM labor.

Thanks Kishore, but my question is what if the salary is way below (in my case 50%) PERM rate?
