View Full Version : I-140 Approved & new Job

Hi Gurus,

I have I-140 approved with my employer's sister concern with PD 2010 June. I dont work for the company through which I got my I-140. Except I-140 receipt number I dont have the acutall I-140 papers. But with the I-140 approval my employer got my extension once already.

Now I am planning to take a full time job.

My questions:

1. If my I-140 company agree to keep my I-140 and file I-485 & GC when my PD becomes current while I work for another company. If so once I get my GC should I need to join the company and work for them for 6 months or so?

2. If my employer does not agree to continue the GC also wont provide me the I-140 papers and also would cancel my approved I-140. My I-140 got appoved almost 2 years back in this case can he cancel my I-140.

Please advise

Your new employer need to start your GC from scratch. But during your I-140 application, your attorney will mention about your already approved I-140 PD and thus can port the PD to your new GC process. That's the general rule.
