Immigration Voice applauds Senator Chris Coons and Lamar Alexander for introducing bi-partisan Jobs Act of 2012. SMART Jobs Act of 2012 is an extremely well thought and the right solution for promoting innovation and competitiveness in United States.

SMART Act has all the sensible ingredients for helping the economy by preserving the best minds here in the US so that new businesses can start and create more jobs, right here in the US.

Here are the key highlights of SMART Jobs Act of 2012 :


Students pursuing masters or doctorate degrees in STEM fields in the United States may enter the U.S. on a new non-immigrant (FĀ-4) visa.
Following completion of their degrees, the students will have one year during which they may continue to reside legally in the U.S. while seeking a job in a STEM field.
After securing full--Ā]time employment in a STEM field, the graduates may have their status adjusted to Legal Permanent Resident.

I want to see a bill sponsored or co-sponsored by Sen. Grassley. If they don't have him, these bills are not going any where. It's just waste of time and resources.

No bills should be introduced before checking with the senators who have concerns; it's a waste of time and resource and moreover, makes the effort look frivolous.

Good if you want Sen. Grassley to sponsor or co-sponsor a bill. When are you planning to get Sen. Grassley to sponsor a STEM bill? Please let us all know so that no one here have to waste any time and resources.

It is good to see "Bills Introduced", but none of these new bills appear to address the "problem in hand" with backlogs in EB based immigration. Yes, it will help few get on other line and free up some numbers subject to CAP, but does not do enough to address the worst affected EB backlogs. Again it is just a Bill introduced, Not sure how far it can go in an election year congress. Any relief for EB immigration is welcome. Hope one of these bills gets through the congress for the President to sign. At the same time, hope the E3 mess is getting attention as well.

It is good to see "Bills Introduced", but none of these new bills appear to address the "problem in hand" with backlogs in EB based immigration. Yes, it will help few get on other line and free up some numbers subject to CAP, but does not do enough to address the worst affected EB backlogs. Again it is just a Bill introduced, Not sure how far it can go in an election year congress. Any relief for EB immigration is welcome. Hope one of these bills gets through the congress for the President to sign. At the same time, hope the E3 mess is getting attention as well.
well said..i do not understand what we are celebrating here by congratulating these bills. these kind of bills come and go as seen before, also these bills are not even addressing any of our immediate issues. it makes me feel that we done with hr3012 and picking up something that not relevant at this moment. What are the chances of these bills getting passed, based on the climate, zero.

Yeah we are frustrated and know such bills come and go but there is still signifiance in the fact that there are legislative attempts being made at high-skilled immigration. Bottomline is that it is heartening that there is still some activity on high-skilled immigration and based on the above, IV is playing a role in the bigger picture. Merely sitting back in our chairs and calling BS on any bill that has our provisions is stupidity..we need to keep our eye out for these bills and whenever there is one (including HR3012) that gains traction..wait for IV action items. Being cynical is not going to help anyone.

S.1857/HR3012 is Part of 'Encourage Entrepreneurship and Growth' , the gentleman Senator from Iowa should remove the hold , because ,

S.1857/HR3012 will encourage innovation by liberating the scientists, doctors, nurses , hi-tech workers to get job mobility and go on to research new products, start new businesses and services , thus improving national economy.
will help to create new enterprises and hire more people to help grow the US national economy
will liberate them to move on and buy houses , thus create more jobs and improve the national economy, (will also bloster the housing loans and banks here)
will help them spend more with the greater sense of security than they will have now, improves overall consumer confidence and improves national economy
will make the best and brightest to be remain here in USA, rather than compete or start companies elsewhere other than USA, will improve nations jobs.
will also reduce outsourcing as some of them will go on and start training locally thus improving local economy
will create more jobs when folks buy homes , improves the construction-building industry thus improves economy

Personally I do think granting green cards to hi-tech workers are great and let them stay to buy house and via broad demand of services and products to create more jobs to boost up national economy. However, this is NOT covered all Science Graduates and some Science graduates are out of US due to get stuck in the H-1B quota or due to sudden laid off from US employers due to bad economy and back home. Some those Science graduates are from wealthy families too and they have money to set up companies in US but get stuck in the green card process and back home.

So to be fair, I do think the annual 55,000 quota inside the old DV-lottery should NOT be sponsored by US employers. Instead, every qualified US Science graduates should enrol online by "first come, first served basis" regardless whether you are in US or whether you have a US job offer or not. Then the another annual 140,000 employment-based green cards should be automatically upgraded if you have a US job offer or if you have at least 3-6 years H-1B working history to get those green cards even though at the time you applied those green cards you are unlucky to be laid off by US employers.

For the start-up visa, it should be divided into US Science Graduates category or non-US Science category. For US Science Graduates category, each graduate should bring at least US$200,000 to US for starting his or her own company and hire 1-5 Americans. For non-US Science Category, each should bring at least US$500,000 to hire 5-10 Americans---similar to EB-5.

So under this situation, the employment-based 140,000 annual quota plus the annual 55,000 quota inside DV-lottery (but later cancelled to rename another new visa) is still the same----NO additional green cards are issued and this will NOT affect Americans jobless statistics.

For the start-up visa, those people bring money in and set up companies to hire Americans and this will benefit the whole national economy.

How do you think this proposal?????????? Do you think it works fairly to cover all types of Science graduates? If this works, I hope some bills have created by some Senators will be changed for better future of visa distribution to those Science graduates. If it is NOT working, please correct my idea!! Thanks a lot !!

I agree with you EB3 Backlog need to be cleaned first before . I understand new people want to come and setteled . But people who are rotting their lives in USA from last 12 years in these backloged categories. has to be taken care first and then new people can be brought in to grind.
