Came to US Sept 2003 on H4.
My husband worked for a company on H1b from 2002 to 2006,he then transferred to a big company in 2006 without porting his early priority date.the company is a chain company that loves to enslave you,they only transferred the H1b but they did not file for labor until 2008.
Our son is going to college this year as an international student,he has a GPA of 4.1 and ACT score of 30.
I am just tired of staying at home .
I wish to know if it is possible to still port the priority date 2002 to the one of 2008.
I will appreciate any suggestion .

You can port anytime you want as long as the company is willing to do a new labor in EB2.

Did you apply for I-140 and have a copy of the receipt...if so, you can do the porting and get the GC immediately. Otherwise its not possible.

As I understand, porting is not tied to Labor. It is requested when filing 140. Even after 140 is filed , you can probably request to port the date . Talk to an attorney.

I know one person who did not request porting but CIS automatically considered his old PD based on old Approved 140.

thanks all.
I talk to the lawyer that filed with the new company,they said a pharmacist is filed for under EB3,he has a 4 year degree Pharmacy degree Africa and he has done his Pharm D(is a 2 year course) here in USA.
But he is in good rapport with his old employer,and he has the no of the Lawyer that filed the Old Labor,but my fear is the time involve ,he had the first priority date on May 2002 and the last one of April 2008,and seeking to port in 2012.

Find the old I 140 and make sure it is not revoked - Then port

There is a law that states any subsequent I-140s filed after the approval of the first I-140 should automatically assume the old priority date. It is not necessary to request for porting of the case, all you need to do is inform the USCIS of alien number that you got through your first I-140 so the new I-140 filing automatically takes your old PD.
