My Labor and I 140 was approved a year ago in EB3. But my employer hasn't share the copies of both Labor and I 140, I have only Case number.

Now i am planning to apply FOIA for both these documents.
1) What is the procedure of applying these ?
2) Will my employer be notified ?
3) Will they provide any case number for tracking my case ?
4) How long it will take for me to get these documents ?

Normally labour and I-140 is the property of the sponsoring company.
They need not have to share that with you except give you a priority date and case number
They can always deny to issue you a copy.

Try that and post here if you can force your employer to get one.

I am nto a lawyer, it happened to me by my company, you just have to believe them and watch for your priority dates

Good Luck

You can certainly get a copy of these thro' FOIA. Several have done that. The employer is not notified.

Cared to google ?

Check USCIS - Freedom of Information and Privacy Act (FOIA) (http://www.uscis.gov/portal/site/uscis/menuitem.eb1d4c2a3e5b9ac89243c6a7543f6d1a/?vgnextchannel=34139c7755cb9010VgnVCM10000045f3d6a 1RCRD&vgnextoid=34139c7755cb9010VgnVCM10000045f3d6a1RCRD )

Read the instructions for the form then post you have any questions.
