Hi All

I came to the US in 2000 and my previous employer applied for my GC under EB3 India in Nov 2004. After I switched employers in 2009, my currently employer filed a new petition under Eb2 in 2011 June. My Eb2 I140 was approved under premium processing on Sep 12th 2011. But it was sent to NVC my mistake. After several Infopass and senator Office visits, today, I got the email saying "Card Production Ordered". Finally my wait is over. Through the years, I have had several pains and though I have my GC approved today, it is more of a relief than real happiness. Nevertheless, I am sure several of you are waiting still for their day to arrive.

We should be glad that we have IV behind us to help us help ourselves. With the dedication shown by IV and all its members, I am sure we will come across a day, when everyone here has his/her card in hand soon. Best of luck to everyone. Good Luck and Thank you IV.

I will continue to contribute in any way I can to IV and its causes, until each and everyone here has their GC.

After so many years of waiting, finally received an email about "card production ordered".

Writing here my case history, so that others can benefit.
I will be more than happy to answer any questions.

I had 3 year Bachelors degree and a 2 year Masters.
Then 5 years of IT experience through CompanyA
Arrived on L1 through CompanyA in USA from India in 2003
CompanyA switched to H1 in a month after arrival because L1 renewals were risky.
Worked for them for 6 months in USA.
Asked them to start GC process, they said no.
CompanyA did not do GCs as some internal policy; switched to new CompanyB on H1.

As you see before joining CompanyB, I had Masters and then 5+ years of experience.
CompanyB did GC processing only in EB3 because there was a general fear that USCIS did too many RFEs or audits if filed under EB2.
CompanyB did the old style labor 750.
Priority Date 25 Aug 2004.
EB3 based I-140 was approved sometime in 2006.
USCIS assigned a particular A# on the I-140
Could not apply for I-485 until the July 2007 fiasco.
Applied for AOS, AP, EAD during July 2007 for me and wife.
I mentioned the A# on the I-485 application
Once I and wife got EAD, I updated I-9 to show that I am in EAD and not on H1.
Wife used EAD to get SSN and started working too.
I-485 had different A#s for me and wife.

Since 2007, regularly applied for EAD and AP renewals for both of us.
For all EAD and AP applications, I used A# mentioned on I-485 receipts.
I also kept renewing H1 and wife's H4 all the time throughout this process.

I-485 was pending in NSC.

CompanyB recently decided that its okay to do EB2 for employees.
So they started a new EB2 based process for me.
They would show my prior experience since current experience with same employer cannot be shown.
Advertisements, labor using 9089 took 6 months.
EB2 based I-140 applied using premium processing.
Added a letter in the application stating that I had different A# on old I-140 and different A# on pending I-485.
No RFEs.
New I-140 was processed by TSC.
Approved in 15 days in mid Oct 2012.

Oct Visa Bulletin set the EB2 India priority date to 1-sep-2004.
Created Service request to interlink new EB2 I-140 to the old pending I-485 and to approve pending I-485.
I was told that it will be taken care of in 15 days.
I also mailed TSC and NSC a letter (created my own format based on inputs from IV forum and some other site) regarding the same
request, mentioned the referral number of the service request.
I added copies of old I-140, new I-140, pending 485 receipts of wife and me.
Added Copy of Pearson Memo.
I did an extra thing: faxed the same stuff to NSC.
After 15 days I was told that Interlinking was done.
But was told that it will take 6 months for approving I-485.
Did not wait.
Called Local Congressman who within 2 days told me that your case has been picked up by officer and that
I should hear from USCIS in 2 weeks.
I still emailed NSCupdate email address to approve quickly because I will lose the chance if PD changes.
Received email today that 485 was approved and card production ordered.

As you can see from my case, My companyB should have filed in EB2 in the first place itself.
If I look at the PD history, I should have received GC in 2006 itself.
So upgrade was the only chance for me.

Next steps for me: Wait for I-485 approval letter, get passport stamped and then wait for cards.

I got my card within a week. I got the welcome notice and the very next day the physical card in mail.

I am amidst of interfiling as well and it has been more than a week since i heard that my case was interlinked and assigned to a officer.

Now sitting and wondering what next ! i have done everything that you have done other than the fax & email for update (requesting approval).

After 15 days I was told that Interlinking was done.

Ie did you get a email OR Mail OR did you call L2 etc .....

Steps:
After I received the actual I-140 approval letter,
- I created SR by asking for L2 staff, gave them my I-485 receipt number and requested that USCIS should consider my new EB2 based I-140 for my pending I-485 case.
- L2 staff said that he is creating a SR, gave me the referral number and said that in 15 days we will contact you if Interlinking is done, via email.
- I should have waited for end of 15 days but no, I was impatient
- On the 10th day itself I called Congressman's aid and she instantly realized that my case was clear and easy and she called me back in 2 days saying that USCIS has assigned an officer to my case and that I should call her back in 15 days. I became sad, because I was expected to wait another 15 days.
- At the end of the 15 days from the point I created SR, I called USCIS L2 back. They said that we emailed you that interlinking was done. But in reality I never received any email. But I said ok thanks for that information, that my interlinking was done, but when will my I-485 get approved. He said, according to the email we sent you, we will process in 6 months. It was at that time I felt more sad. But I said thanks and hung up calmly.
- Now I was impatient, so I emailed ncscfollowup.nsc@dhs.gov with my SR number as subject and said

Hello Sir/Madam

I had created a service request on xx/xx/2012 to interlink a new "approved" EB2 based i-140 to our pending i-485 cases, and to approve those pending i-485 cases of me and my wife.
I called USCIS today and I was informed by USCIS today that the interlinking has been completed on xx/xx/2012.
However I was told that it will take 6 months to approve I-485.
Since priority dates for EB2 are current, in our case, can you please approve our pending i-485 cases?
Your help in this matter is really appreciated!

Our case/receipt numbers:
New approved EB-2 I-140: SRCxxx with Priority Date 08/xx/2004
Old approved EB-3 I-140: LINxxx with Priority Date 08/xx/2004

I forgot to add one more point.
After SR I had also mailed overnight to TSC/NSC and faxed NSC that, hey guys, I have created this SR to interlink. But since you never asked me any copies of new I-140 and old I-140 and pending I-485, here there are. Mailed copies of all receipts and even faxed NSC 402-219-6171

Can you give me your atterney's contact information. I am trying to convert my case to EB2. I have 20 years of IT experience. I have 3 yrs Bachelor+2 years Master+1 year Diploma in computer science. Now I am doing MSIT. It will be great if you can give me your atterney's number.

My companies inhouse attorney did all the work for me.
Except the 485 process and the interlinking process which I did.
He cannot process cases of non employees.
I have learnt a lot about the immigration process and although I am not an attorney, I and this forum can try to analyze your case and provide you some inputs. PM me.

Update: yesterday received email about CPO, then another about some ADIT processing/ welcome email, and today another email, the third one basically, which says Cards mailed. I am still going to local uscis office to get passport stamped since I am traveling out of USA soon. I do have AP and I am sure cards will arrive in 5 days, but it does not hurt to get passport stamped. I am going to take only email printouts because I haven't really received the welcome mail yet. I am sure uscis will be okay with that. I will update later about how it went.

I have sent copies, emailed, contacted senator, created SR etc etc.. as of last week they mentioned that the case is assigned to an officer on 11/2/2012 and now i need to wait. They don't know if it will be a month or 3 month , depending on the work load of that officer. Even the senator's note said wait 30 - 45 days.

My only question was based on the PD, should our cases come to top automatically ? anyways ... frustrated that have to wait more that 1 and half month even after PD gets current with about 10 years of wait.

Thanks for all your information and help, i will send another email and ask for an update... I guess i will have to wait for some more time.

Based on your signature your PD is listed as Nov '02 EB3 - India. If that the case, sad but true your PD is not current even in December unless your PD falss on 1st of Nov.

In that case, you might have done what you need to.

Now that your case is assigned, hope you get it soon. Just keep pushing in through your local congressman's or Senator's office since you have already established contact. Though they will wait until the time they are told, they will hear back from USCIS.

But I still recommend that you write to the USCIS "update" email addresses, as the one more last step.

Choose the one where your 485 is pending:

California Service Center: csc-ncsc-followup@dhs.gov
Vermont Service Center : vsc.ncscfollowup@dhs.gov
Nebraska Service Center: ncscfollowup.nsc@dhs.gov
Texas Service Center: tsc.ncscfollowup@dhs.gov

My prediction is that if the officer has picked up the case you should see it within 15 days of picking up the file.

As per State Department there were hardly any cases left before 2005, so you should see it soon.

I relatively positive that you should get your green card within 2-3 weeks as soon as you’re PD becomes current. You do not need to try anything more other than just sending an email to the service center or creating an SR request when your PD becomes current. I am basing this off of my personal experience and many friends that received their green cards after waiting for 10 years.
My PD became current in October. Sent an email to NSC on 1 October. Got response back on 14th October that an officer has been assigned to my Case. Green card got approved on 17th October. Welcome Notice and Physical card received on 21/22 October.
I would suggest not to send more information to USCIS than what is asked for. Your case is most likely pre-adjudicated and just waiting on Visa Number.

Thank you all for your responses, i sent an email for update and now will sit and wait until end of the month, like the response from my senator's liaison which was 30 - 45 days. Will get in touch with them if i am still waiting.

Can you pls let me know if you got a FP/biometric appt. before your approval....I am in a similar situation and had FP in 2007 and now filed for interfile (PD is Feb 2003) and wondering if i will get a FP appt. or not?

Started last year July, got delayed in prevailing wages report, later advertised etc ... and finally filed the PERM App in Jan, got approved in May, then applied 140 in June (premium), approved in 2 weeks.

I received another email today that card production ordered.
Yesterday itself, I had taken an INFOPASS appt for today.
Went to USCIS office, got my passport stamped.
A printout of CPO email, original 485 receipt and passport was enough for them to stamp.
Stamp is valid for 1 year only since they say card will come soon anyways.

I know this question was for Bang but I can share my experience as well.
My new company agreed to do EB2 processing in March 2011 & then the company's attorneys took their own sweet time. Finally, they filed my case in Oct 2011. My case was audited on Jan 09, 2012 for which they replied by Feb 06, 2012. My Perm was finally approved on July 28, 2012.
Filed for my I-140, on Aug 26, 2012 under premium processing. RFE'd on Sept 05, 2012. Response was filed on Oct 26, 2012 and approved on Nov 05, 2012.

A big note here - My company lawyers are terrible and work @ snail's pace. Could be my companies fault since they probably are not as prompt in clearing their payments either. Also, could be I have a shitty luck. I am in this country since 1998. Even lord Rama's vanvas ended in 14 years..I will probably beat that record..Cheers!!

Yes the process you described for creating SR is correct.

i just went thru' the same steps...EB3 PD is Feb 2003 and EB2 140 got approved on 10/5. Filed 485 for wife on 11/5. Got receipt on 11/13 and sent interfiling email on 11/13 and got a response next day that FP need to be done for wife and my case will be pulled for review and expect some action in 30-45 days. Haven't opened SR or congressman yet, may be will do that next week. Only thing i did not plan is travel out of country is not recommended after 485 is applied and without AP. I had plans to travel to India this December but most likely need to cancel it.
