Dear Immigration Voice Member,

As we have been consistently sharing the progress of H.R.3012, On Tuesday 11/29/11 the US House passed H.R. 3012 to end per country limits from high-skills immigration by a convincing 389-15 majority.

Immigration Voice applauds House of Representatives for passing H.R.3012 with such a significant majority.

There should be no doubt that your efforts are paying off.

During this moment of historic triumph, we would like to pause to thank members like you who have put in hard work and hard earned money behind this effort for 6 years. This was not easy and we know the feeling. And this is not a small accomplishment either. But there is more work to be done, and this bill has to pass the Senate and signed by the President before it becomes the law of the land. Legislative process is like a relay race. The House has passed the baton to Senate and the Senate will pass it to the President. In a relay race, every baton holder is important. To get this billed passed in the Senate is a challenge. It will not be easy. But we will never relent. We need to sustain this properly and mount a massive effort at the earliest so that Senate gives this bill the attention it needs and the approval it deserves.

Last time any immigration bill for high skilled immigrants passed in the house was in 1999.

So this is a big deal. The is no excuse now for any lack of funds or hard work for senate. We need everyone involved. Please spread the message to everyone. Time is very short and we need to give our best to get this done in the senate.
We need to think beyond the support of a couple of hundred people contributing $ 25 , 50 100 . Other organizations lobby with millions in their budget. For example Aila has 13 million budget per year to lobby. For us doing in shoestring budget is a miracle. The reality is very different but it shows that if all of us work hard nothing is Impossible. It will take time ( it took immigration voice 5 years) but we are now in the last stages of the marathon.
The success of this bill is in the hands of each one of us reading this post. Please do your part in this history we are all making.

the above piece, like many others fail to mention that anyone who is impacted negatively by this is only because they are getting in line in their appropriate position, FIFO rather than jump ahead based on nationality. Is there any outreach to these reporters to make sure they understand what they are reporting so they frame the story appropriately without distorting the truth/facts?

Is it 2011-Oct or 2012-Oct. If 2011 - Oct will it be from the date he signed the bill as they can't revoke the visa numbers that are already processed this year right?

vdesai: Unfortunately we can't predict that as all people from the backlogged countries couldn't file for I-485 after July 2007. So it's hard to predict the date without knowing the demand. But one thing is sure that you wouldn't wait like many of us.

11/30/2011: Two Positive Notes for H.R. 3012

Lifting annual numerical limitation after three years is tremendous benefits for Indian and Chinese EB green card applicants. There are a couple of additional good news for these EB Indians and Chinese:
Effective Date: Should this bill be enacted without amendments by the Senate, the law will apply retroactively to October 1, 2011 during when they receive additional numbers.
Senate Judiciary Immigration Subcommittee Chairman, Chuck Schumer's reported prediction: The New York Times (paper edition) of 11/30/2011 reports that Senator Schumer stated that the bill would be handled swiftly. Accordinly, there is a gleam of hope that this bill could even be enacted before the end of the year! I think the prediction is based on the current Congress that refects a strong bi-partisan support for this legislation.

Remember Grassley is Republican, The Senate Majority and its Leader Harry Reid are Democratic

We should have faith in the fairness of the bill

Senator Grassleys Objections are :

- What does this bill do to future immigration flows?
it only makes them fairer by maing it first come first served for employment based immigration. If this means that most of the EB numbers will be from a handful of nationalities, that is because the sills required by the markets are such. Diversity in immigration is preserved by Diversity based immigration where these India and China are disaalowed.

- He concerned that it does nothing to better protect Americans at home who seek high- skilled jobs

Quite the oppoite, it maes it easier for the americans to compete. It is easier for an american worker (and fir the american economy) to compete aggainst an immigrant of foreign origin who is on american soil paying american taxes than it is for the american worer to compete against a worer overseas who works at 10-20% of the pay. Worse, the companies hiring the offshore worker dont pay much US taxes either. The current bottleneck in employment based immigration encourages offshoring to this extent

Now we need to work with the senate majority leader to allow Mr. Grassley to debate/fillibuster, for better or for worse

one further point :

it does not add a single employment based visa number. To that extent it does not take away any existing protection of the american worker. He is already quite well protected, given the LAbor Certification process, doocumentation of hiring efforts etc...

I am sure you good folk are on top of this.

I am not sure of this, but would a formal communication from IV with a well argued, detailed analysis that shows no impact of this bill on American workers along with CBO estimate of budget neutrality help him tone down a bit? Maybe actual visits to him from IV leaders to explain our position and desperation?

Guys, please, I know we all really want to see this through but please, understand that there is a process here, and at the end of the day we are in good shape. Just hang tight and let us do our thing. If it makes you feel any better, we knew this yesterday and knew this was coming almost weeks ahead. Let the process unfold and things will happen. In an effort to create more awareness, today I tried to talk to 3 of my neighbors who are from India on H1Bs in the last 2-3 yrs.
I was shocked to note that they knew nothing about the GC mess, as they say their employer promised them after 3 yrs. They also ask what this bill is and what IV is.

Lesson learnt:

Personally I lost $100,000 in this wait as I threw that money in rents instead of buying a house, apart from the pain.

Last time any immigration bill for high skilled immigrants passed in the house was in 1999.

So this is a big deal. The is no excuse now for any lack of funds or hard work for senate. We need everyone involved. Please spread the message to everyone. Time is very short and we need to give our best to get this done in the senate.
We need to think beyond the support of a couple of hundred people contributing $ 25 , 50 100 . Other organizations lobby with millions in their budget. For example Aila has 13 million budget per year to lobby. For us doing in shoestring budget is a miracle. The reality is very different but it shows that if all of us work hard nothing is Impossible. It will take time ( it took immigration voice 5 years) but we are now in the last stages of the marathon.
The success of this bill is in the hands of each one of us reading this post. Please do your part in this history we are all making.

Just a thought - I have plenty of colleagues at work stuck in a rut like me waiting to be current. Most of them have never heard of immigration voice. However, it is not a time to panic or spend time imagining the "worst possible outcome". We have reached here. Can one of us say with confidence (before pappu or other posted) that they even could dream of a 389/15 support in the house??
The "hold" and/or any other obstacles should only serve to strengthen our determination even more. Let us fight at any cost. Remember those among us stuck in 2001 and 2002. Any and every member, particularly our software brothers who often have huge numbers of contacts should pool in many more folks into this fight. Forget about the outcome now and concentrate on the task. Donate if you havn't done yet and invite others to join.

What you said is absolutely correct. We are all excited now. And there is a lots of hope.
But its also true that some of us are disappointed with Grassley's hold.
I personally do not understand the impact, and so are many here.
We request IV leadership to address this situation and let us know what this hold means, and the impact. That way the momentum we're building only increases and not the other way. People shouldnt be discouraged by these things, and would like to know what exactly this means. To my understanding there are 100 senators and we need 60 votes to pass this. I may be wrong. Please help us on what to expect next.

House Passes Bill to Eliminate Per-Country Limits on Employment-Based Green Cards
November 29, 2011
Executive Summary
If the bill becomes law, it will equalize the waiting times for employment-based permanent residence, which would result in significant advancement in employment-based green card availability for India and China and retrogression for certain other countries.


The U.S. House of Representatives tonight overwhelmingly passed the Fairness for High-Skilled Workers Act (H.R. 3012), a bill that would change the way employment-based (EB) green cards are allocated by eliminating country-specific quotas. If the bill becomes law, it will equalize the waiting times for EB permanent residence, which would result in significant advancement in EB green card availability for India and China and retrogression for certain other countries. The bill would also increase the country-specific quotas for family-based green cards.

The bill will not become law until it passes the Senate and is signed by the President. The Senate is expected to take up the bill soon.

If the Bill Becomes Law

Under current law, no more than seven percent of the total number of EB green cards can be allocated to the natives of any single country. If there are more green card applications than immigrant visa numbers in an EB category for a specific country, the State Department determines a cut-off date for applications. A foreign national whose priority date (his or her place in line) is earlier than the cut-off date for his or her EB category and country of birth is eligible to apply for adjustment of status or an immigrant visa. A foreign national whose priority date is later than the cut-off must wait in a green card queue until more immigrant visas become available for his or her country of birth and preference category.

If the bill is enacted, the way EB green cards are allocated would change significantly. The seven percent limit per country would be eliminated by 2015. Instead of separate queues for each country in each EB green card category, there would be eventually be a single queue for each employment-based green card category.

Until 2015, per-country limits on EB green cards would still exist, but a certain number of immigrant visas would be allocated to India and China and away from other countries. As a result, priority dates for India and China would immediately advance at least a year in the EB-2 and EB-3 categories. However, for other countries EB-2 could retrogress and EB-3 could see further retrogression. By 2015, the EB-2 and EB-3 categories would be backlogged, but there would be a single priority date for all countries in each category.

How Changes to the Quota System Could Affect Employers and Foreign Nationals

If the bill is signed into law, a large number of foreign employees born in India or China will become immediately eligible to file applications for adjustment of status or immigrant visas in the EB-2 and EB-3 categories.

At the same time, those born in other countries face the possibility of future EB-2 and EB-3 backlogs as the government transitions to the new green card allocation system. Employers planning to sponsor foreign nationals born in countries other than India or China would need to file labor certifications and immigrant worker petitions as early as possible to secure the most favorable priority dates.

Because backlogs would still exist in some preference categories after the transition period, the bill points to the continuing need for an injection of additional numbers into the EB green card system. Several bills now pending in Congress would create an exemption from the EB immigrant visa cap for foreign nationals who have earned an advanced degree in science, technology, engineering or math (STEM) from U.S. universities. These proposals would not only speed the permanent residence path for holders of U.S. advanced STEM degrees but would ease demand on the EB green card quota.

I would request everyone to show patience. Just to put things in perspective, what people believe as a setback regarding the "hold", IV core has faced lot worse for the past 6 years to come to this stage where we are on the verge of getting something done. If you are going to get despaired with what happened once in the last 2 months, imagine what core team went through every month for the past 6 or so years to get to this stage. We should be thankful for the dedication and determination of core team for getting things to where they are. So, we have two options, either we can keep freaking out and add to core team's worries, or take this latest obstacle in stride and show faith in our leadership.

I'd also like to clarify that though I am a donor member, I had been a passive one for quite sometime until I participated in the most recent advocacy day event. It would be an understatement to say it was an eye opener. It was an amazing experience where you see that there are hurdles at every step and how core team keeps its composure and focus on the end goal.

Everybody has questions and need answers. For now I'd rather have the core team spend all its energies working on the bill. And I'd rather that we all be the strength for that team by donating generously, contributing, spreading the message, and of-course by not worrying :D.

An important note about action items is to wait for core teams directions. Any unconcerted efforts on our part can be counterproductive.

Everyone know that it is no easy task to move an immigration bill since it is a touchy subject for the politicians. The fact that this bill got to this stage is that the politicians had been made aware of the drawbacks of the current system and the strength that this bill namely to stop the reverse brain drain that is happening now and strengthen America(albeit a small step in the right direction).

What this means is that we have more explaining/lobbying to do. The fact that it passed with a great majority in House and expected to get the same level of support in Senate is itself a very positive thing. As the several members of the Core team already said :"Hang in there and be the part of the movement"

HERE ARE FEW THINGS RELATED TO HOLD AND HOW TO REMOVE THE HOLD:

HOLD - An informal practice by which a Senator informs his or her floor leader that he or she does not wish a particular bill or other measure to reach the floor for consideration. The Majority Leader need not follow the Senator's wishes, but is on notice that the opposing Senator may filibuster any motion to proceed to consider the measure.



filibuster - Informal term for any attempt to block or delay Senate action on a bill or other matter by debating it at length, by offering numerous procedural motions, or by any other delaying or obstructive actions.


Holds, like filibusters, can be defeated through a successful cloture motion.

cloture rule originally required a supermajority of two-thirds of all senators "present and voting" to be considered filibuster-proof.[5][6] For example, if all 100 Senators voted on a cloture motion, 67 of those votes would have to be for cloture for it to pass; however if some Senators were absent and only 80 Senators voted on a cloture motion, only 54 would have to vote in favor.

One Common Challenge IV faces , as IV lobby's if we are shy of necessary people , donations... the common paradigm we are trying to project is "WE as a community dont care about our delays... Hence Lawmakers might very well think why to care about when members dont dont care about our problem..." with this delays a person with PD of 2004 may end up getting GC after 15 years are more... Dont jump on me... see the numbers there are atleast a million of people in this ship... and when iv organized grass roots not more than some hundreds showed up.. I am not questioning commitment who sincerely couldnt come but atleast NOW when IV proved that we can do something sitting back and refreshing the thread is not an option... Friends,

I am keenly following HR3012 for last few months from the side lines. Though I would not have any impact of this, many of my friends will be benefitted. I was surprised that many of them do not even know about this even though they GCs are being processing and they are waiting in line for ever now. Few of them became IV members and started contributing.

Now all of them have the question that what is this 'HOLD'? Is this the end of the road for this bill? Same concerns are expressed by other members on this thread. I dont think there is any reason to panic or worrry. Here are my 2 cents as to why we should not worry.

What I see from news post regarding "Hold" the Senator primarily had 2 concerns.

1. This bill is going to increase the no. of immigrants
2. This bill is going to effect the job opportunities for highly skilled american workers in this hard economy.

As far as my knowledge goes both these concerns are unfounded due to following reasons.

1. There is not going to an increase of even a single Visa no. with this bill. Meaning no increase of immigration.

2. The question of loss of jobs for highly skilled american workers does not arise. This bill is not going to change anything. If an American worker is losing job today( which he is not as there is stringent PERM process which is required to show that qualified American worker is not available) the same will continue without this bill also. It is only that instead of qualified candidates waiting in GC line for decades the other candidates from diffferent country which is current are going to take that job. In any case 140000 nos are granted by law and they are continuously being exhausted for last several years. The same will continue with or without this bill.

3. I am sure the people who are working hard to get this bill passed will be able to convince the Senator that the current high rate of unemployment has nothing to do with highly skilled Amercian workers. I was reading somewhere that the rate of unemployment for Bachelors degree holders is only about 3-4 percent( if it is only IT then i am assuming it would not even be 2%). So the high unemployment rate is not a correct indicator to block this bill.

If a layman like me can understand this concepts, I am sure IV would be able to convince any Senator who has concerns and get to remove the hold easily. After all we are in a democratic country where decisions/rules are made based on majority opinion. I am sure American constitution also has ways to handle it.

I request all IVians not to panic or worry too much about this. With the kind of hard work and efforts put in the people behind this bill, I am sure it will be a law soon. It is just the matter of time.

According to another immigration site run by an attorney, if this bill passes, it will be effective as of Oct1 and will work to eliminate country limit over the period of 3yrs. How exactly they are going to splits the numbers are not clear.:o

Is it 2011-Oct or 2012-Oct. If 2011 - Oct will it be from the date he signed the bill as they can't revoke the visa numbers that are already processed this year right?

Lets not speculate too much especially here on this open forum with each bit of information that comes our way, who knows from what sources. If there are serious issues that the core team cannot resolve, I'll bet we will hear about it sooner or later. Bottom line is we don't know the entire picture. I trust that whoever brought this bill this far expected all this turbulence and have done their homework. My gut says stay tuned to the folks on the ground and react to their feedback and directions!

Again people, if there are serious developments, the IV core will inform us of it. I'll panic when the IV core starts to panic..so far there's nothing of that sort. Quite the contrary..go back a few pages and you'll see. IV team, other than deleting these posts, it might be helpful to chime in once in a while to dispel rumors and calm nerves!

Was just reading processing within House v/s within Senate .. And it is different than few poster mentioned here that Senate ride would be smooth .. People whoever could contribute more, please contribute as much as, you can. It seems, we would need more lobbying power than it was in House.

Many people on H1s and also who are in GC process are ready to pay almost $1000+ for premium processing for extension approval or for I-140 approval immediately - many a times, just to relieve mental tension. If those people can contribute there, why not to contribute at least half of that here to an organization who is actively working for good. Remember all your money is audited and is in good hands, and directly going towards work towards this bill.

If someone has to wait for 1 more extension because a particular GC category is taking long -- and if someone has to pay $1000 or more for premium processing or loose better promotion somewhere else for couple of more years, because GC is delayed -- it is more cost than donating $500 or more here.

Can someone know, if the donation is tax-deferred? If the donation is to non-profit that most likely it should be. It would encourage more guest to contribute considering it would be tax-deferred.


It would be obvious from the following understanding / article that Senator needs more lobbying effort than House.

The article mentions 2 critical points, which could tell that we would need more lobbying efforts this time --

(1) If a debate in house is taking in 1 day, in Senate similar debate could go upto weeks. (as above article mentions)
(2) House represents small group of citizens v/s Senate represents entire State, so there is a founding difference in mentality between House v/s Senate -- so, we are dealing with a bigger Dad now, so more lobbying.
(3) House representative are elected every 2 yrs v/s Senate are 6 years, so Senate has more stronger voice, and so the bigger lobbying would be necessary, this time -- not only to pass the bill in the favor but also to move the bill quicker -- We all know the impact of delay in this case is costly too.



For IV core team - You guys are just doing fantastic work, and must be busy now-a-days, but was wondering, are you guys are making this movement visible more, as well? Like putting the effort and the donation link to

(a) Sulekha or similar immigrants (interest group) news paper,

(b) Volunteers having a small stall at famous Grocery area, where the target group (immigrants - e.g. Indians) would visit more on weekends,

(c) Seasonal Immigrant's event (e.g. Diwali Party etc.) .. I will not be surprised to receive good contribution from good immigrants who are already citizens now and have gone through the same trouble or feel our trouble. Those people usually donate good amount in social events for some minor cause -- this is for good and result-oriented cause.

(d) Also, IV -- Can we ask our friends in IOWA to contact IOWA Center for Immigrants Leadership and Integration for their support to this rational cause? Grassley from IOWA requested for HOLD, so if we get support from some organization from IOWA, it would help making Grassley understand the good cause here.

Their proposal would eliminate the per-country caps on visas issued to highly skilled workers, essentially allowing more well-educated people from India and China to work in the United States.

Currently each country can claim only 7 percent of the 140,000 work visas issued annually. The bill also would boost the cap from 7 percent to 15 percent on family visas, allowing more people from places such as Mexico to reunite with their families.

The legislation sidesteps the hot topic of undocumented immigration. It also doesn’t increase the total number of visas provided in a year.

While a wide swath of Democrats and Republicans supports the measure, Grassley has reservations.

“I have concerns about the impact of this bill on future immigration flows,” he said, “and am concerned that it does nothing to better protect Americans at home who seek high-skilled jobs during this time of record high unemployment.”

Lee and Chaffetz, along with Sen. Marco Rubio, R-Fla., plan to visit soon with Grassley.

“I simply think it is a matter of education and communicating with him,” Chaffetz said. “The only way to even get one of these visas is you have to demonstrate that there is no American who has applied to fill that job.”

Great going everyone. We need everyone to pitch in a big way to support. This is history in the making . We are all working together to end the discrimination and unfair provisions in employment based visas. We have suffered for long and now it is time to work together to do what is right.

Do not pay attention to rumors or panic. Just check iv official updates to know the status of the bill everyday. We will be posting on these red colored threads whenver we want to make any information public or have any action item. We are on top of things and working on this for a long time and gained lot of knowledge on how things work. So do not worry about these techicalities and any misinformation you get on other websites. This is a marathon and we are going to approach the finish line very soon. All we need is your full support. We need your best support beyond $25 so that we can put in our best effort. There is no second chance at this stage and we need to get through. IV core is doing a great work and spending lot of time and energy on it. And that is going to benefit all of our families and our future. It is as simple as that. Contributing money is a very small thing when compared to what IV core is doing for all of us. Just leave the side lines. Do that small thing of contributing for our future. I was a side liner, but I decided to do my small part. So I started for my own future.

I am not a IV Core or a senior member. I was a side liner until recent. I know IV needs all hands to pass this bill. I got my green card in June 2011. Just learned that the congress voted to eliminate the country limit. This is the greatest news ever. I am going to contact my senators to vote for this bill. Good luck and prayers to get this passed in the senate and signed by the president.

Because of my emails to my friends , 2 of my friends contributed $100 each last week. One of my other friend contributed $100 on the week end. I contributed twice $100 in last few weeks. Keep talking to friends. Just tell them how important it is and ask them to visit IV. Once they visit IV, they themselves can understand the situation.

Please don't take it personally if your post is deleted. Moderators are being extra careful in this crunch time to ensure that no post undermines the effort of thousands.

I am not sure which of your posts were deleted and hence cannot comment about them. But rest assured that if your post is deleted, it was deemed to undermine the effort in some way.

In these cases, I would suggest that you send a PM to moderators (any of them) with your content and ask them why the content cannot be posted or why the post was deleted. That may help .

Please understand that at this time, there are many opposing the bills who post here to derail the bill. Though the bill is about fairness and is about treating everyone equally, there are few who do not want their GC to be delayed by even one day, even if it means that the older applicants(who have already been waiting for 3 years before them) will wait for 5 more years. These folks post under the guise of supporting this bill, but their only aim is to do everything possible, ethical or not, through truth or lie, to derail this bill. Such kinds of posts need to be deleted. Hence the extra attention by the moderators.

Regardless, I would urge you to continue with the action items. Remember that this is not a favor you are doing to anyone. You are following the action items to help you and your family. So please do not refrain from the action items just because your posts are being deleted.
