On Thursday morning (10/27/11), The Judiciary committee in the House took up our bill H.R. 3012 and voted on it in the first half of tomorrow's session. The bill passed. This is big news for all of us and most of the credit goes to you for your support in terms of both actions items and contributions.

While this is an important step, the judiciary committee is only the first step in legislative process. Now it will be later taken up in the House for a full floor vote sometime in next 3-4 weeks. And then it will be taken up in the Senate. Much work remains to be done on all fronts.

Please help us continue this effort by contributing funds (http://immigrationvoice.org/forum/misc.php?do=donate) so that we can continue our work and our advocacy effort in Washington. This is the first time in 11 years that a bill for high skills immigration is being taken up in the committee. And this may be our only chance for many years to come. We need all hands on the deck to pull this through for the next step.

Now that you've seen the efforts of IV and it's success in bringing a bill this far, you should seriously consider signing up for monthly donation. It can be for a minimum amount of $25/- which you will definitely not miss, but which will greatly help IV in planning it's future efforts. And if you sign-up for the monthly contributions, you'll also be given access to the donor forum.

Thanks all for donations. What we are seeing here is magic in the making - the true power of democracy, persistence and leadership from IV. As much as we all like to visit various immigration websites to understand this process, IV is the only organization fighting on behalf of us every single day.

Great News and glad to hear it passed the first Step! Few questions on mind like time frame for this to become law and how far EB3 queue will move forward once it is implemented confident of course we will succeed in other stages of House/Senate vote.
I was considering porting for a while as i have MS degree from US but i am hopeful that this will be faster than porting. Thanks IV for all your efforts to fix this broken system and i continue to support all your efforts!

My Question is Does IV qualify for the gift matching program ?

Some other requirements are -

Eligible organizations:

All institutions must qualify as tax-exempt organizations under section 501© (3) of the Internal Revenue Code; or as defined in 110.1(1) (a) of the Income Tax Act of Canada. We will match gifts in the following broadly defined areas:

Actually the amendment is only for transition rules. The country cap is removed from EB1 as well, but there is no transition period for EB1. It is right away.

The reason for this is that EB1 is current and it benefits the US the most and there is no impact to anyone as everyone is current in EB1.

The amendment is to apply the transition rules to only EB2 and EB3. All others will be without country caps from the beginning.

This does not have any impact to anyone because other than EB2 and EB3 all others are current anyway all the time.

There are some other nuances, but at the high level, the amendment is to apply the transition rules to two backlogged categories only.

At this site simply search for BIll - HR3012. Then register and you can support the bill. Website gives you link to support, where you can write letter and your local senators would get your letter(based on your zipcode).

Please share and send letters to Senators.

If you can port then port (no question about that). Meanwhile (if you have not done yet) try to join the currently ongoing contribution action of IV. Contributions from each member counts. Nobody can provide a clear answer to your question and even if somebody does there is not gurantee that it is correct. So please contribute, however small if not done yet. :):)

If there are only 30K before your application then you should get in an year or so.

If you can port from EB3 to EB2, that's the best thing to do than waiting n predicting the numbers n dates.

Please contribute to IV's efforts for EB Community (IF you haven't done already). and inform your friends also to join IV's efforts.

In present day scenario, to get to your priority date Visa bulletin will take atleast 10 years, which is around 2021, if this bill passes, by 2012 christmas you might be holding the green.
To make the above possible, please do your part.

1) Join IV
2) Contribute your share
3) Follow other action items as specified by IV

I think the bill will be taken up in the third week of november, if it doesn't happen, then we have first or second week of december. With the holiday season, window of opportunity is very narrow. Beginging of the next year is considered new congress, all the pending items are toast and new agenda sets in. Guys make as many calls as you can and get this ball rolling, we really have only 4 to 5 weeks left for the end of calendar year.

Everyone who is stuck in backlogs should realize that we are in a crucial stage. In the next few weeks we will have the opportunity to see HR 3012 being passed and helping us get out of this never ending wait for a GC.

There is opposition and we have to push through all of that to get this passed. The small minority that opposes is making weird arguments about how this bill is bad for "diversity" and the economy blah blah. Basic fact is that they are not willing to wait even for one extra day (i.e. 1 day beyond the very inconvenient 1 or 2 years they have to wait for today) even if it means someone from India/China has our wait times reduced from 10-20 years to 4-5 years.
This is all the more reason for us to UNITE behind IV and get HR3012 passed. This is about making the system fair .. period.

IV is the ONLY organization which is lobbying and advocating on our behalf in DC. Even Rep.Chaffetz (who introduced this bill) recognized IV in their press release. There can be no better proof of IV's dedication to this bill. Let us realize that and stand fully behind IV to lobby strongly and get this bill passed.
Become a part of this effort, contribute or at the very least be interested and active in what is going on.

Yes this is indeed a critical time. If we all actively support IV now this might indeed be the first of many such successes that legal EB-based immigration folks can achieve. IV is certainly poised to launch such activities for the EB community now and in future. Having understood the pains/struggles of this journey most of us are committed to support even after our individual journeys towards the GC gets completed as proven by several members, including the leaders, who are doing just that. :):)

If you are a recurring donor, I don't think you need to request , as I never requested access and some one from core contacted me via email to grant access few years ago.

...............but they have EAD's. They have houses, spouses can work and no visa stamping hassles.

Yes... thats sad, but true!

Its the general Indian psyche. We are more self-centered and less community-oriented. We don't help or stand for things from which we don't get a direct tangible benefit.

Moreover, this is not an Indian or Chinese bill - this is a bill benefitting American society. Any rationale thinking person would agree and that is why this is being considered in the congress - because a reasonable number of rationale thinking people believe this will benefit American corporations.

Now what to say of these EAD-holding, GC-holding Indians turned Americans - its sad that they don't support the cause.

I have experienced the same behavior with few of my friends too; they made fun when I went to 2007 rally in DC. I have seen such poor mentaity when it comes to shell out money for other good causes too e.g. if there's an earthquake/natural disaster; they think that any donation would end with corrput people and that's there excuse for not donating any money.

Luckily such negativity is in minority and most of my friends do sympthize/support such good efforts (though they have GCs). So the bottomline is not to give up hope and keep hammering. I have known IV for more than 4 years and I know that the IV admin team has done fantastic job taking time out of their busy schedule to bring in the fairness. Go IV!!!

I had hard time to convince around 10 people to call house judiciary members. 2-3 persons eventually called and still few times. One person even called 3 house members offices and that's it. Most of them told me they don't have time to call. Instead they had time to go to news websites or deal sites. I did not even tell them to donate as I know they would laugh at me. They have been telling me about their difficulty that they cannot do such and such things as they don't have GC but when they get the chance to call or involve then they don't have time to get involved. Last year I went to DC for meeting lawyers with IV's initiative with one colleague and everybody else laughed at me and asked me why you spent money to go to DC to meet lawmakers.

If this bill passes and people who will get their GC will not even care to find who are the real unsung heroes behind this bill. It is like how many remembers IV efforts behind the scenes contributed to let every one to enjoy the EAD after 2007 fiasco (remember flower campaign ?).

Fortunately there are few dedicated folks relentlessly pursuing this thankless job to make things better for EB community. All we can do is atleast to make few calls or donate some money , or take some time out of our leisure to meet a law maker.

I was reading many posts regarding lack of positive responses from many IVians' friends. When I sent out emails regarding the phone campaign, I thought none of my friends would care. Nobody even told me any thing despite my many emails to them.

But when I asked them about it after a week or so, almost all of them had called the judiciary committee members. Many had contacted their other friends and posted the news on Facebook etc.

So I would not be discouraged by a few negative responses. People with negative attitude is in the minority. IV is largely successful.

I also have EAD but I do support immigrationvoice and participated in action items. You can not generalize everyone. I donated personally met Eric Cantor who is representative from my area, to give a letter to support the bill.
We can ask others to suuport and if they like they will support but at the same time we cannot force everyone with EAD to support the bill.

You might want to talk with IV leaders directly and contact the representative since he is responsible for scheduling / permitting bills being debated?

I have the same experience with my friends and colleagues. Most of them are in EB3 category. I had hard time to convince around 10 people to call house judiciary members. 2-3 persons eventually called and still few times. One person even called 3 house members offices and that's it. Most of them told me they don't have time to call. Instead they had time to go to news websites or deal sites. I did not even tell them to donate as I know they would laugh at me. They have been telling me about their difficulty that they cannot do such and such things as they don't have GC but when they get the chance to call or involve then they don't have time to get involved. Last year I went to DC for meeting lawyers with IV's initiative with one colleague and everybody else laughed at me and asked me why you spent money to go to DC to meet lawmakers.

Bottom line is that we need to be focused on our objective, not on who which one of us have EAD etc., who cares or not etc. Every phone call counted, every letter counted. We made it through the first step with who supported the cause. You will always find in every group a few that don't want to do anything, but it is always dedication/dedicated group that beats apprehension and non doers. There are many EB3 here that help, want to help, Contribute. So here we go!

There is no going back now. We have a bill and we are going to move forwards. Will there be hurdles? Oh yes there will be. Should we withdraw and not point out the flaws in the current system? No we should not. What ever be the result, atleast we will have succeeded in pointing out some major flaws in the system. How can anybody justify a system which has a country based quota system for employment based visas?? There is none for H1b and there should be none for H1b or EB-based GC also.

Probably I am the most unfortunate among the unfortuantes. My PD is July 2004. But what happened is, when the gates were opened, I did not have my I-140 approved, so I couldn't apply for EAD. So now I have my i-140 but still sitting on with it, and going through the pain of stampings , what not!!! I guess if this bill passes i will become current cand can file my EAD/484 together. What a pain!!! Praying this bill pass through. Can't appreciate the work IV is doing.

Very sorry to hear that, Hope some thing good comes thru , at least I have EAD, still some times I feel so unfortunate, last weekend I was watching old home videos from 2003, when I applied my GC I was young just married and now after 8 years I am getting old and still waiting for green card and with out this bill I have to wait another 5 years at least.

As per my knowledge you don't have to be 140 approved for filling 485. If you can file 140 and 485 together then why cann't when 140 is pending. if your labor was pending then its different story.

I am just like one of you. My labor got approved mid September 2007 and I too missed the gates by 20 days. So I cant apply for I485/EAD. Waiting indefinitely to apply for I485/EAD. USCIS not willing to hear our real stories. Hopefully this bill will get through. Amen.

Sorry to hear your situation. Some times we who were able to file for I-485 during July 2007 are lucky. I am also in the same boat and if the bill does not pass it takes another 6 years for me to reach the finish line.

I feel your pain. I came to this country in bill clinton era. clinton left, 2 terms of bush and 1 term of Obama and here I am working in a great company that will not sponsor EB-2 even though I have Masters + 10 years exp. God bless this country and this great company !!

You are looking at number of PERM applications approved in a year. In 2010, a lot of backlogged applications from 2008 & 2009 were cleared. You should look at data by PERM filing date and you see a different picture. Also the multipliers are out of whack.

It is estimated that from post-July2007 to Dec2010, there are about 85,000 applicants (primary and dependent) waiting to file I-485 in EB2-India&China category. If you search the predictions thread you will find it.

A simple break down was:

July 2007 to Dec 2007 = 16,000
Jan 2008 to Dec 2008 = 27,000
Jan 2009 to Dec 2009 = 18,000
Jan 2010 to Dec 2010 = 24,000

Total 85,000

Yes that is true. IV might come up with seperate action item on that soon. Meanwhile hopefully more people join the contribution effort that is on currently. It will help both ways anyway. Let us not put the burder (financial and effort) on the shoulders of a few. Have faith...:)

Sometimes two separate bills are introduced in senate and congress to ease the logistical and technical issues. They both can get passed separately and will become in the conference committee and forwarded to president. I am hopeful house will pass the bill next week, if not it will be first or second week of december.
