Dear Members,

We are excited and pleased to announce that after 6 years of our hard work, your hard work, we finally have a bill that has a very good chance of actually passing in the Congress in next 6-8 weeks.

For over 6 months, members of Immigration Voice have been working behind the scenes to bridge the gap between various sides, coordinating between different groups, our employers and petitioning the Members of Congress. On the 4th anniversary of Immigration Voice rally, members from across the country organized over 160 meetings with the key decision makers in the Congress. To prevent any unnecessary attention we coordinated and organized these meetings with energetic and highly motivated group of Immigration Voice members and leaders.

On 22nd September, Congressman Chaffetz and Smith sponsored H.R. 3012 in the US House of Representatives. We applaud Congressman Chaffetz and Judiciary committee Chairman Lamar Smith for leading the effort for removing per country limits. The proposed bill H.R. 3012 removes per-country limits in employment based green card category. If enacted, this bill will drastically reduce the wait times of everyone in the current backlogs. A similar bill was sponsored by Congresswoman Lofgren in August, 2008. So the idea of this bill has bi-partisan support in the Congress. Immigration Voice applauds Congresswoman Lofgren's leadership on fixing high skilled immigration system.

The most important thing now is to give this effort a final and consequential push. Although this bill has wide support, it is not a done deal yet. We all need to actively get involved in making phone calls and sending emails/faxes to the Congress in order to give this bill a grassroots voice and also to out-number, outlast and out-weigh any push from either people opposed to immigration in general or opposed to removal of per-country limits. Now is not a time to take a break and risk 6 years of effort that went into reaching this phase.

We all agree that high skills immigration should allocate and distribute green cards to the skilled immigrant workforce based on principle of first-come-first-serve-basis. Members of Congress have listened and now they agree with this principle. Our employers whom we wrote letters and petitions internally in large high-tech companies also agreed with us. And even when our case has lots of merit, merits alone do not drive the legislative activity in Congress. There are many bills in Congress that have a lot of merits and can do a lot of good but are never voted in Congress because a small faction holds it up. We cannot let that happen to us, not this time.

You are successful in your job and in your career trajectory. You either like your job, or, you like where your career is headed. However, in order to protect our accomplishments and our position in life and career, working really hard at our jobs is not enough. We have to protect what we have and what we aspire by making sure that we will be around in this country for the foreseeable future. If you have contributed time, money or effort so far to Immigration Voice, that’s great. But that is needed again for next 6-8 weeks. If you have never done this, now is the time to do this. If this bill fails, there will not be another bill in 2012 because that’s an election year where legislation do not happen easily. In 2013, the chances are slim again and depend on election outcomes. So this is it.

If you recently received your green card then you can easily relate to the problems your friends continue to go through. If you are only 1-2 years away from being current in your case, a lot can happen in next 1-2 years. You may face a worse economy, be laid off, be in a company that gets acquired by another company or merges with another company. All this is not good for green card process. Go IV Go - I think all of us stuck in this GC mess should come forward and at least help with pushing our Congress people to pass this bill - Anybody who sees this and does not contact their senators/congressmen is just plain stupid no matter how close they are to getting their GCs. Also, I urge all folks who have recently got their GCs to help fix this mess once and for all! Thanks to IV leaders like pappu for carrying the mantle this far - Now it is our turn to do everything we can to push this forward!

So, how will the execution pan out? Will all the PD in the visa bulletins be updated based on FIFO i.e. will all categories have the same cut off date?

It's fairness and justice in EB based categories. Go IV go. It will not affect any country on planet. If you are skilled and if you are first in line you will get it first. Rather than chef from small country get prior to top 5 tech university in the world has to wait forever unto 70 years.

We all have applied for gc of America and we are future citizens of this country so we need to make sure America remains top in innovation in world. This bill will ensure this.

It will boost job growth in this bad time for Americans.

glad to see some progress. Discrimination based on National origin is illegal everywhere except while waiting for green card and its high time racial/national origin quotas are discarded in employment

There wont be any ROW category...its only based on the PD and EB1/2/3 FIFO

but it will be done in a phased manner. I guess ROW will exist till FY 2014 or 15.

The bill is being phased over three years and it ensures (through limits and reservations) that all backlogged countries (India, China, Mexico, Phillipinnes) get relief and also that ROW has some reserved numbers as well. This ensures that the backlogged countries get relief while only minimally affecting the other countries in the transition phase. After the initial backlog is cleared, its a system based on fairness and first come first served.

This is a first step towards broader immigration reform and hopefully we can try for more piecemeal reform in the future like STEM exemptions, recapture of unused green cards from past years etc. In the current environment it is very difficult to get anything that increases green card numbers.

Thanks to IV core and active members for their efforts in getting it so far! Lets all help IV to get this across the finish line by participating in the upcoming action items and contributing.

It would help if someone can provide more details regarding why we are more hopeful about this bill than the numerous others that have been introduced before but die silent deaths in various sub/ committees?

I am sure there are reasons for this hope, as I have never seen IV sound as hopeful about a bill before this.

The system will treat everyone fairly...its doesn't matter which country you are from...if you file with PD 2010 Jan, you will get the gc based on that...your counry of origin wont matter.

All along I have supported the removal of per country limit with a proviso that we get an increased visa number at the same time. This bill will not reduce the backlog; it will just redistribute it. I wish we are able to get an increased visa number at the same time or at least one of the other measures that will eliminate the backlog (not counting spouses and children for instance).

Its great if we can get the extra numbers...but you see how the economy is doing

Does this bill still make a distinction between the various EB categories? How will spillover work in this case? Or will it be one big pool of applications based on PD, irrespective of whether you file in EB-2 or EB-3 category?

You nailed it...in addition, H-1B visas issued should be proportional to GCs issued in a given year...time and again, we've seen increase in H-1B visas with out a corresponding increase in GCs issued. To top it off, L-visas created a ruckus in the system and contributed to the GC Backlog

If it is passes, bill will be effective from fiscal year 2012 (so immediately) but will be implemented in a phased manner. In the first year country limits will be eliminated for only 85% of the numbers and 15% will be reserved for ROW. In 3 years time (2015 onwards) the system will be completely fair and based only on first-come-first serve principle, for each EB category.

This is excellent news. I may sound greedy but when this bill passes, is there a possibility that USCIS will allow all with approved I140 to file for AOS (just to get the idea of exact queue)?

In My opinion all categories will become current, or will become current by next year. Because of the weird and divisive quota formula, they keep the reserve for people who haven't even applied yet. This is worst form of reservation system. Our careers got screwed because of this quota system. Indians are biggest sufferers everywhere, we suffered because of quota system in India and we suffer a worst form in US.

I am not even in the GC queue yet and am excited already because I know that I will be in EB3 and have been worrying about the wait for a long time. I know it is not a done deal but this seems to be a step in the right direction. Like the fact that the only thing in this bill is removing the country based quota.

This bill is the result of hard work of several generations of dedicated individuals at IV.
Over the years the requests for fairness in high skilled immigration has needed countless trips and hours spent to meet individual lawmakers, explaining why it is not fair to wait 70 years to get an employer sponsored green card, just because you come from specific countries.

There can be no backlog reduction without an increase in visa number, period! As I previous stated on this thread this will merely redistribute the backlog. I support this but I would love to see us work on and obtain backlog reduction remedies as well.

Yes. After the markup vote on 13th/14th, it will be voted on the house floor. After it passes the house floor it has to be voted by the senate.

Wow if this bill passes, it would be such a great relief from the grassroots discrimination against people from developing countries. Per country reservation is just unjust!

This will greatly reduce/completely eliminate wastage of numbers that happens every year.

2. In a few years EB2 wll be current for all and EB3 ROW will have a uniform wait time of 4-5 years for all.

3. After this bill passes we can focus on visa recapture, excluding spouses/family etc
Right now this is all we could get that would make a difference to the vast majority who are waiting in the queue.

Many thanks to Rep Chaffetz and Rep Smith on the Republican side, and Rep Lofgren on the democratic side for making this bill possible. This goes to show things can happen in the 112th Congress.

This bill will enormously benefit the thousands of green card petitioners who are waiting forever by moving their dates much faster. This creates fairness and equity for all. The best aspect of the bill is that it takes into consideration the concerns of the people from ROW by giving them an assured number of green cards. It'll be a great day of rejoicing when the bill actually passes.

Having been there recently in the advocacy efforts, I cannot stress enough the need for participation from all the IV members. Pls actively participate in calling the leaders, faxing, emailing, donating when the IV core asks you to. The major work has been done, but it still needs pushing from all of us till we get the bill passed.

This is good news. But does anyone know what are the percentage of green cards claimed by ROW in a year? Is it more than the 15% that is reserved for ROW in first year. Also, would have like to see this not clubbed with family-based quota change.

But even with these things, this is the best chance we will have to remove the unfair country quota. Please let all your friends who are not part of IV know of the action items. A generation of new skilled immigrants from India and China would be grateful to us if we can see that this bill is passed.

You can call them even if they are not from your district. Some staffers may say you have to call your congressman. You can try this script for that situation.

"The reason I am calling is, the congressman is on Judiciary committee. This bill is coming up for a markup this week in judiciary committee ".

This worked for me.

Just call and introduce yourself. You don't have to be from the same state to call. I'm form TX and I called all republican members today no matter from which state they belong to.

We are calling all judiciary committee members even if you are not from their district. As clarified and suggested in the original action item post, mention that you have spoken to your own representative's office as well but since the rep you are calling is on the judiciary committee, he/she is a leader of national importance and therefore his/her support is very critical for this bill. hence your call.

Good to see some positive light..... we are seeing some light now. But lots remain to be done. People need to talk to their lawmakers to get it passed.

One key thing is that IV has given the spotlight on GC process mess. As I have mentioned in the past, with GOP doing better and Democratic party losing the house and hopefully the senate, skilled immigrants will have better chance in future years.

For the record, I support this bill.

In my readings so far on this forum and others I've read two arguments against the proposed bill:

* Reduces diversity
* Increases wait time for ROW

Within the context of this bill, I would argue that since the total number of visas / approvals will remain the same, the issue of reducing diversity does not arise. If you are in the GC queue you will get it. So the overall diversity numbers are not affected in any way.

Next, the only reason ROW members receive quick turnaround is because of the artificial quota system. It is clear that the quota system is broken, because it penalizes certain groups of people. With the proposed bill, the wait times are the same no matter the nationality. I am sure everyone understands the queue and first come first served concept, be it in a post office, for a bus, etc.

I have seen people posting why IV does not get behind any legislation that is aimed towards high skilled immigrants. The answer is simple , not all legislation introduced will see voting floor and rather than working on multiple legislation, IV works hard on legislation that have good chance to get through congress.HR 3012 is the most promising one at this time and as such we all should concentrate to get it through as it has the blessing of Rep. Lamar Smith.

This post is generic in nature. I have highlighted certain lines in red to make people aware how things move in congress . What hurdles immigration issues have faced and how much ground work IV has done . Law makers have now stepped up to work on issues that are very important to high skilled immigrants.

Please lend your full support to HR3012 . I am confident that we can accomplish rest in a phased manner by supporting IV by volunteering, donating and working for rather than against IV objectives as united EB immigrants rather than EB-I/C/ROW or EB -2/EB3. I want to end with a single line I learnt in school:

United we stand , divided we fall. It is time to be united and build the momentum to get through this long endless mess.

I called in to the offices of about 10 congressmen / women offices just now. The staffers are pretty friendly though in a bit of a rush. I wasn't able to convey the whole message as it is but I made sure they got the jist of it.

Its very simple guys, just call them and ask for support on HR 3012. Also do it fast guys I didn't realize the offices were in Washington DC and its about time they are all going home.

Since lot of you are asking this question, let me explain it you all with an analogy.
Let us suppose Indian Chinese and ROW people decided to go to a movie. There are 3 counters to get the ticket and there are 40K seats in the theater. Theater has these policies:

1. for a noon show, it cannot sell all tickets at once even if there are 40K people standing out. It will only release 10 K tickets starting 8:00 am. Of those 10K tickets only 800 tickets would be released to Indian / Chinese viewer through two counters designated for Indian and Chinese customers. Rest 8400 tickets are made available at third counter each hour. Since most of the customers are from India / China, counters for these countries have long lines where as the third counter is empty waiting for customers to come. Those who come get tickets immediately while Indian and Chinese wait for hours for the counter to open again. Customers who are served by third counter are happy because they have to just come and get the ticket. It does not matter when they arrive, ticket is just ready for them. This is just unfair for Indian and Chinese customers who are standing for hours knowing that there are tickets but they have been kept on hold just because they are from particular country.

Just 1 hour before the show, theater is allowed to open tickets across all counters , now there is a chaos for theater management as well as Indian and Chinese customers. In this chaos , theater management is overwhelmed with demand on all three counters and messes up with payment , ticket numbers etc. Both theater as well as viewers loose in this last minute race but viewers lose more as if show starts, theater cannot sell remaining tickets (if left) and viewers would have to wait in same long lines till booking starts for next show and same controlled release is followed. Now if viewer is stuck again in the line for hours.

Now imagine there is just one counter and there is no artificial control on sale. The first one who arrives at theater gets the ticket and moves in. If Indian/ Chinese is first, he gets in if ROW is in he gets in. This makes life fair for the customers and much easier for ticket sellers who now have clear visibility for the demand as they have just one line to cater with not phantom demand getting created at last minute. This prevents last minute mistakes in allotting tickets, method is fair to people from India and china who have been waiting for hours and crowd is easier and simple for theater to manage too making whole process simple for every one.

I hope my attempt to write an analogy has not made things more complicated :D

Some of the offices which initially started with "not sure" about their support have told recent callers that they "will support" the bill. Also some offices have notified IV that they appreciate the thank you calls.

Please note this is how total support for a bill is estimated. Every single call is noted down. The staffers who handle calls note down how many for and against calls they received for each bill and then use the following to tally up how much support a bill approximately has:
Each email is counted as 100 supporters
Each call is counted as 1000 supporters
Each in person visit is counted as 10000 supporters

We have to completely drown out calls against the bill by the opposition. So those you haven't called yet, please do so today and tomorrow. And those you have already called, please call again if you have time and also spread the word.

I am not sure what these people against know about this bill. Everyone thinks if it is immigration it is not good. It is not giving out anything extra no more visas. It is just bringing fairness into system. First come first serve. I am not sure what they get when they call against this bill.

Folks, people have been working for this particular bill in the background for over 6 months and years on advocacy. These things don't get done in a day. Getting laws changed requires patience and persistence. So it wasn't discussed because of lack of time, not a big deal. Keep up the good work. We need to keep the momentum going and drown out the opposition with our overwhelming support. Continue with the calls, spread the word and stay tuned for new action items from IV.

And also it will be very helpful for the IV members to know what the next steps will be? What happens to a proposed bill due for Mark Up if the committee did not have enough time to discuss? If the time frame is known, it makes it easy to convince several others to call.

Unfortunately I watched the session in 2008 and also last two days. It becomes very demotivated at the end if you are watching very closely. I know from my side, only thing I am able to do is contribute money and only small amounts of time. But I appreciate the IV's consistent trials.

Whether the bill was taken up for discussions this week is not relevant. We need to keep calling and contributing our time and money towards this cause. This is the only way to get any relief.

Updates are good, but I would prefer final result without updates rather than updates without result. While it satisfies our curiosity, I think patience and persistence are key to achieving our goals.

If IV thought that there was no use in doing this, they would not have asked us for such participation. I am sure if there are any updates worth sharing, they would have already done so.

Once you attend any advocacy day, you will understand, as I did, that IV is the only organization that is on the side of skilled immigrants and also the ground reality. IV does not care about EB2/EB3, ROW/ICMP etc.. they represent any and all skilled immigrants regardless of their country of origin and category. After having attended advocacy days, I can share that I saw this in action. I am sure anyone who attended any advocacy day will share the sentiment.

So please keep calling. While it is good to get constant updates, we need to realize that IV core also have their full time day jobs and are taking time to work on our behalf even though some of them already have their GC. There is no other organization like IV that works on our behalf.

But there is only so much the core team can do alone. They need our support to achieve any relief. Let us join hands now and support OUR cause to bring relief to us.

Keep the pressure on and keep calling and get your friends stuck in this mess to call. This is a fairness measure that will help level the playing field. This is the first step towards relief.

As you can see, the core team only asks for our support when it is really needed. So now is not the time to analyze what is happening behind the scenes. If there are updates worth sharing, they will. If not, we can assume that they are working behind the scenes to help us.

The bill is in very good shape. There are updates and you will get them shortly. Seems like the email did not reach all the people for some reason. Please understand, these are a group of volunteers working round the clock (along with their day jobs and other responsibilities) to get this done. Please be patient and continue with the participation. We need everyone to chip and do the best they can to get this across the finish line.

I am just a regular member but for the people who are constantly seeking updates, what I know is that IV core group is working hard and other members are also, bill may come for mark up next week and it hasthe support ,because Mr.Smith is a Co sponsor and there are other things also which makes the bill very much needed at this time. It is very critical at this point for every one to contribute and join hands to complete the task in hand.

there is some progress in opencongress.org from 122 as of morning we got 350 at this point.

We can do much better here...all it takes is register and cast your vote as simple as that.

Also please sign-up for new action item which is very critical at this point of time.

Will EB2 applicants have to wait until EB3 PD reaches the same date as EB2 as a result of this bill? Will this bill cause EB2 and EB3 PDs to be the same going forward?

Not at all!!! EB2, EB3 will move independently as they do today.

Please look at the overall picture and how this will help all backlogs to reduce. The big picture is that everyone will benefit.

No change in EB3/EB2 handling except country will be out of equation. Who ever comes first gets it first. Thats the only change.

The legislation would phase out existing quotas on the number of employment-based visas that may be awarded to legal immigrants from a single country. Current law limits any one country to 7% of employment-based permanent resident visas, causing enormous backlogs for legal immigrants from certain large countries that provide America with large numbers of skilled immigrants. The bill also adjusts upward the per country caps for family-based visas from 7% to 15%.
