View Full Version : I-94 Validity during 485/EAD and Advance Parole

Hi all,

I have a weird situation. My current status - 485 pending, Working on EAD and travel using Advance parole (Same status since 2008)

I went to India in May 2009. Upon re-entry, they stamped my I-94 until Dec 2009 (AP expiring in Dec 2009 as of that time). Ever since I have been extending my AP and EAD and was maintaining my status. Until today I did not see that my I-94 expired in Dec 2009. I have never traveled to India since that time and I want to go now (next week). Is this going to be a problem ? I checked with my company lawyer and they told that I-94 validity during EAD/AP stage is not critical. And I should not have a problem. Does anyone have any thoughts on this ?

Simple answer is NO PROBLEM.

Just so you know when you come back, your I 94 should be stamped for 1 yr after yr date of entry, regardless of when your AP expires.

The fact that date means absolutely nothing, is another matter. :) Makes no sense I know.
