Free attorney conference calls

IV Members,

Immigration Voice conducts a one hour free conference call with attorneys for the benefit of IV members only. Depending on the interest, this opportunity is provided on the Thursdays of each month.

3rd Thursday of this month - 4 pm PST / 7 pm EST with Greg Siskind & Ari Sauerm from visalaw.com

Note: For this particular call, the attorneys requested questions in advance. Members are required to send their questions directly to (IV handle - actaccord ) or post on this thread for everyone's benefit. I'll send the compiled questions over to Attorneys by Wednesday Sept 14th afternoon 12:00 noon PST. At the conference call, the questions will be answered in the order in which they are received now.

Members need to be present in the call for the question to be asked and answered.

Is it ok to post question here and not ask the question over the phone? The reason is I will be in office (I am in california) and I do not want to be out or not available on my seat for several minutes.
I can probably join in the conference call as a mute participant and will appreciate if the moderator can ask the question on my behalf. If at all I won't be able to join I can hear the conference recording. Kindly advice.

Also where can I access previously recorded conference calls?

First of all thanks for your help. My question is given below ===>

Question: How to get spouse in US w/o an immigration law-change?

Background:
1) I'm on EAD and have my own company (C-corp) so getting back on H1 may be difficult.
2) PD is Aug 2005 and category is EB3I :mad:
3) Got married in Aug 2011 in India and returned back on AP. So status is Parolee.
4) I'm on a long term contract for last 3.5 yrs and will continue to go on.
5) Spouse has 10+2+3=15 yrs of formal education and around 4 yrs of experience.
6) GC is not the highest priority for me as I will return to India permanently by 2014.

Possible/Probable Options:
1) Visitor visa or F1.

2) H1 for her won't be feasible from a payroll point of view even if rest of the H1 nightmare goes well. And from a legal view point
this won't be the right thing to do.

3) Port to EB2 by filing GC from my own company (For this I have to transfer ownership of my company to somebody else but I have someone whom I can trust so that's not an issue but not sure how DoL and USCIS will react to all this). On getting GC do a "follow-to-join"(i.e. another 4-5 months).

4) Port to EB2 by filing GC from some other company (Just hate this option as I have to take full time with another company and have to lose control that I currently have on my own destiny. Previous employer gave hard time). On getting GC go for follow-to-join.

5) File H1 from my own company. That will need a. change of company owner (not sure if self-sponsoring of H1 that we have been hearing recently will work.) b. going thro' H1 process c. going to Canada for stamping (heard this is better than COS.) d. Wife has to go for H4 stamping (221g :eek:)

6) File H1 from other company. Indentured servitude again :( and above steps apply

7) Work from India. Yeah that is an option but don't how long the client will tolerate it.
Client is a really nice person(like all my previous clients were) so hate to ask repeated
favors from him. Also I have to work from Client certified location for security purpose.
In my case it is Vendor's offshore development center in Bangalore which is far from my home town.

Visitor visa option would be great (even if she has to go and come back after every 6 months) if it works. (Latest Update: Last night I spoke to my friend. She told me her friend who had a GC was able to get his wife on Visitor visa)

Apart from that I think/hope option 3 along with 7 (for "follow-to-join" period) maybe workable but not very sure.

Is there a way to apply on EB2 on the same company using the experience gained on the same company. I am working for 8 years on same company and EB3 is applied. Would like to apply on EB2 using experience gained because I don't have experience prior to this?

I am having Engineering degree with 10 years of experience .I worked for Company A for 8 years .Company A applied my Green Card through EB3 and it is approved and I am in EAD now .Then I went to Company B for 6 months worked over there .After 6 months again I come back and Join in Company A in different group with different position and start the new job .In this period Company B has filed my AC21 as well as Company A also filed AC21 after I joined into the new group and position . Now my question is whether Company A can file EB2 for me .
