IV Members,

Immigration Voice will begin conducting a one hour free conference call with attorneys for the benefit of IV members only. Depending on the interest, this opportunity will be provided on the Thursdays of each month.

1st Thursday of this month - 4 pm PST with Raj from Carl Shusterman's office

Members can pm their questions to me (IV handle - actaccord) or post it on this thread for everyone's benefit. Members need to be present in the call for the question to be asked and answered.

Actaccord,

I would like to join the conference call for tomorrow. My question is, I was under H1b since 2005, my employer applied for my I-140 for EB3 last Jan 2009 and it was approved. While waiting for my priority date my lawyer realized that I qualify for EB2 and he applied for my I-140, 1-485, AP and AED last October 2009 under EB2. I received my AP and EAD 3 months after. I didn't renew my H1b that expired Feb 2010 because i'm using my EAD that time. Dec 2010 I received RFE for my EB2 I-140 and i replied to that by Jan. 2011. My lawyer follow up last July for the result of RFE but last week USCIS website posted that my I-485 was denied and reason was mailed too but I have not received it yet. My EB2 I-140 still pending for the result to the RFE. My lawyer informed me that I might need to go outside the states for 30 days because they need to apply for my H1b and be interviewed by the consul in my country's US embassy. He said that I will be out of status since my I-485 was denied and that means my EAD will be revoked or no sense at all now. Is it necessary for me to go outside the states for my employer to apply for my H1b or can they apply it now under premium processing since the company is not for profit without me going out of USA? Please advise!

I would like to join this conference. Before joining current employer I've Bachelor of Engineering (B.E.) & 4+ years of experience. Would I be eligible under EB2 with certain wage limit rather than experience?

and get clarified...I would like to join this conference. Before joining current employer I've Bachelor of Engineering (B.E.) & 4+ years of experience. Would I be eligible under EB2 with certain wage limit rather than experience?

I would like to know what the new announcement from USCIS is about. Does it make it possible for a person with work experience as a sole proprietor to come to US and work as an employee, or does it allow him to sponsor himself into the country?

I appreciate your effort in asking this question for me, but the question was not clear the way you asked. But since Raj was not prepared for it anyway, would it be possible to give this question to him so he can get back to us later?
