IV Members,

Immigration Voice will begin conducting a one hour free conference call with attorneys for the benefit of IV members only. Depending on the interest, this opportunity will be provided on the Thursdays of each month.

1st Thursday of this month - 9 pm est with Prashanthi Reddy from Reddyesq

Members can pm their questions to me (IV handle - prem_goel) or post it on this thread for everyone's benefit. Members need to be present in the call for the question to be asked and answered.

Thanks for the service you guys are doing. here is my question for upcoming meeting

I worked for company A till 2009, they applied for my PERM and I-140 is approved in 2008. My priority is Aug 2007. I am now working for B. They applied for my PERM in 2010 and it got approved. Now I-140 is in progress. My employer is saying that he canít allow me to file I-485 until the I-140 is approved even if dates become current ( he will not allow premium processing of i-140 even though I am ready to pay the cost)

What should I do in this scenario? I have copy of my previous approved I-140. Please suggest. Can I go ahead and file I-1485 ONCE the dates becomes current? Do I need the existing employer receipt notice for filing my I-485?

My question:

PERM Labor & I-140 approved through Employer A. (Priorty Date June 2007)
Employer B applied for PERM labor and got a RFE. If Employer A is willing to provide paperwork needed to apply for COS, What do I need from the employer A to apply for I-485 & EAD?

My question:

Are we still able to combine 1 year of master's degree with 3 year bachelor degree to make up 4 years? What if I have cleared a large majority of all subjects, but never cleared a single year of the master's completely?
How about combining the 3 year degree with 1 year graduate diploma? is that still allowed?

I'm hoping to file for I-485 in the next few months based on the EB2 India date movement this year. My priority date is July 2007. I wanted to start collecting documents needed for this paperwork. I've a question about the birth certificate for my spouse.

My wife has the same last name as me even before our marriage. She used her father's first name as the middle name. After our marriage, when she applied for a passport, per Indian customs, she assumed my first name as her new middle name. All her official documents (Passport, Visa, Master's degree, Driver's License) now use the new middle name. I don't recall if passport authorities required any affidavits of middle name change. Even if they did, I don't have a copy of this affidavit in possession.

However, her birth certificate uses her father's first name as the middle name. So, obviously there is discrepancy between middle names between passport and birth certificate. Her birth certificate does spell out her full name, father's full name, mother's full name like a typical birth certificate.

In a situation like this, do we have to submit secondary evidence of birth? Are there any affidavits required? If so, which ones? Can any of these affidavits be made in the US?

I very much appreciate your help in this regard.

The recent AC 21 memo states that the job duties must 'essentially be the same'. So long as the occupational classification is same or similar why should the USCIS care about job duties being 'essentially the same'?Seems like going against the intent and very restrictive - why has no law firm commented on this?

I took INFOPASS first time on 5/27 and then called USCIS and took Service Request after which I got the email and a letter about my file being in National Records Center.

I called USCIS to find out about any update on my case, spoke to 2nd Level CSR, she said, my file was recalled by my Local (Newark, NJ) office and it reached there on 6/17/2011.

Is there a monthly allotment quota for I-485 approval ? My PD is current since May.

I have a question regarding salary during the period the person is on 485.

As per knowledge salary mentioned on Perm application is for future.

If the salary mentioned on Perm Application is 100K and he is presently withdrawing 75k.

Once the 485 is filed, does the salary needs to immediately take affect incase the person uses EAD & enter on AP, but does not change job with AC21, or he can remain on the same salary of 75k till the approval of I-485 and once the approval comes, he should be getting the salary of 100k.

My I140 approved, I485 not yet filed and I am on 9th year H1B. Can I change job now with H1B transfer? reapply PERM & I140 and retain old Priority Date. What happens if my current employer withdraws I140 after I change job? Do I lose Priority Date and H1B?

My employer has filed my EB2 PERM Labor on Nov 24th, 2010 and still its pending. We did not hear anything from DOL yet. My employer has responded for the sponsorship verification email from the DOL in first week itself. Now when I check the DOL portal, its showing that they are processing April 2011 cases. My question is now if I contact DOL for my Labor status, do they issue Audit on my case? What are the chances of getting audited if I contact help desk for the status check? My employer's attorney is saying that she got audit on all the cases for which she contacted DOL for status check. Is it true? Please suggest!

If it doesn't apply to you, don't take offense..

Try to make the questions short. I mean, I see many of you simply elongating the argument even after the question was answered. You are making Councillor out of lawyer here. Please consider other people in the line too!
