View Full Version : Use FOIA for I-140 and other Immigration Records

Dear IV Members,

I received a copy of ‘Approved I-140’ using Freedom of Information Act. I took almost 7 months to get requested information. Also I am going to get complete immigraton records on CD using the same method. Following are the steps to use FOIA:

1. Write a cover letter (Sample attached)
2. Complete Form G-639 (Sample form ‘Freedom of Information Act - G-639 - Form.pdf’ attached)
3. Write your I-140 Receipt # in ‘Column 4’.
4. Important: Make sure you complete ‘Column 7’ or you will be asked to send you application again.
5. For ‘Column 8’ you can sign it yourself under ‘Executed in US’ (No need to use Notary)
6. Send this form to:
USCIS National Record Center
FOIA Division
P.O. Box 648010
Lee Summit, MO 64064-5570

I received copy of approved I-140. You can check status of FOIA request at FOIA Request Status Check (http://www.uscis.gov/portal/site/uscis/menuitem.8d416137d08f80a2b1935610748191a0/?vgnextoid=f3a2ba87c7a29110VgnVCM1000004718190aRCR D&vgnextchannel=f3a2ba87c7a29110VgnVCM1000004718190a RCRD).

Folks,

I am updating my post dated 07-26-2009. I received FOIA response (copy of approved I-140) on a CD. I submitted my request on in January 2009 and received response last week .

So your request took almost 8 months..right?
When you got your NRC number by any chance do you remember the number of cases ahead of you..

mine say yours is 5860 of 9449 ..I am asking this to get an estime of time

My request was submitted on January 6, 2009. This was my second request for FOIA to get my records on CD. I started checking status from July 2009. Following is the timeline of FOIS status from July 2009:

Hi All,

I know this is a very old post but could not find any recent ones for FOIA details.

I need more than one document, so do I need to file more than one request?
Also, any advise from anyone who has filed recently would be great!

The Freedom of Information Act (FOIA) is a federal law which grants the public the right to obtain information from United States federal agencies records. There are 9 exemptions under the FOIA law which allows the government to withhold certain information, such as reasons of national security or confidential business information. Requesting copies of documents or records from United States Citizenship and Immigration Service (USCIS) should be completed using Form G-639.

Is there anyway to file FOIA for H1B?

A friend of mine applied for H1B while employed in company-A. Then he left the company-A and joined company-B. Later he got information from his ex-colleagues that his H1B petition is approved. Since H1B quota is completed he couldn't apply for new H1 and hence he wants to transfer the previously approved H1B. But he doesn't have any information (say receipt #/EAC #, etc) about the H1B petition. Is there anyway to file FOIA and get H1B details?

Yes, you can get all immigration details through FOIA.
