Hi

first labor approved in may 2006 under EB3
140 was approved in 2007

Since I already had masters before I joined the company
EB2 labor applied and received approval in Jan 2011

My attorney applied for 140 porting but received priority date as Jan 2011 instead of may 2006. My attorney says immigrations has made a mistake, attorney contacted them and received a reference number basically asking attorney to call back on Jun 1st. I'm concerned on what went wrong and what could be the worst case scenario. How much time are talking about here.

Any information will be greatly appreciated.

Just was curious to know further progress.

My case is also similar to you. I have received I-140 with new receipt date even though I have old approved I-140 with old priority date. My lawyer is contacting Immigration

hello vegaspd,

i was in the same boat few weeks ago , then attorney called USCIS and per them ,they faxed the old labor and old 140 and new 140 and a statement .they sent new 140 with old PD in 2 weeks.total time it took was 2.5 weeks including to get the new approval in mail.

yes its hassle but appears to be more than 50% they don't place the old PD.yes our attorney included the old PD info in 140 application.

If your PD would be current by the EB2 PD port, yes you can file I-485 along with the amendment request.

thanks for your reply. I am also in the same boat. since it took only 2.5 weeks is your application filed in premium processing or regular. Please let me know as my lawyer is saying it may take more time.

if possible my service center is TSC and can you let me know the phone number where your lawyer called?

mine was premium processing @TSC .when you call USCIS and if its premium processing application ,they will transfer to you to premium line.I didn't call but thats what attorney told me
