Sit and Wait until 2016 or later for your date to become current (if filed in EB2 or forever if filed under EB3) so as to file I-485. Keep checking visa bulletins. Other option would be to Contribute to immigrationvoice and others efforts in the hope the senators will show some kindness to legal immigrants and amend the law.

If you are EB1 - file for I-485

if EB2 - join end of the line and wait for 4-5 years to file for I-485

If EB3 - join end of the line and wait for your retirement.

I do not think anyone is really applying in EB3I these days. Only people unaware of backlogs might. But then lawyers and employers should also see if the job position qualifies for EB2 and apply for EB2. Applying for EB3 now is a waste.

hey Pappu,

It is not fair to tell folks not to apply for EB3, what would u advise them to do if their qualification and position makes them eligible for EB3 only?

What if your efforts to remove country quota is a success?

I gave a true picture. I have seen many people completely unaware of the backlogs and realize only after I140 is approved. If someone has a choice earlier, they should use it.

There are lot of people who has 15 years of education qualification and they cannot apply in EB2 category.

There are lot of people who has 15 years of education qualification and they cannot apply in EB2 category.

That is an unfortunate truth. Some people with Masters or 5+ years of experience are stuck in EB3. My advice to people applying for Greencard or in the early stages is to explore the possibility with their employer of their job position requirements fit for EB2 filing. For new filers with PD 2010+ in my opinion application is merely a consolation that they have applied for a greencard. Getting a greencard in the next 10 years is not possible unless there is some legislation to help them. So if someone has an option for EB2, it is worth exploring.
