Hi,

My company gave ma a substitution labor and it is having a problem in term of degree.
My I-485 is also pending based on that I-140.

1. Is it possible to apply new labor and I-140 in premium processing and use that new I-140 for previously applied I-485?

2. In substitution labor that person was having 4 years of Bachelor degree and I have 3 years of bachelor degree, lawyer said there is a chance for get approval for I-140 based on substitution labor.


Please advice.

First of all there is no "substitution labor" anymore..USICS may not accept it according to a new rule set in last yr June..

Yes, there is no labor substitution.
My case has been filed in July 2007.

and secondly there is no i-140 premium processing as of now..:(

I am also on the same boat. Did you get answer for your question? i.e. linking your old 485 to new I-140?

Hopefully there wont be any answer for you guys. People are waiting in line for years and you guys cut short with sub labor. Good keep it up.

Hi All,
Company A:
I am on my 7th year of H-1B visa (6th year expired on Apr30th 2008).
Labor approved Dec, 2006.
I-140 applied in June 2007. (Got RFE regarding my Educational Transcripts
which we responded in time and USCIS received on Dec 5, 2007)
I-485 applied in Sep 2007
Got EID and Advance parole approved.
I-140 Denied on Apr 3 2008.
Applied for MTR (I-120 B). Now it is at Texas Service center (since May1, 2008).

Company B:
Now this company applied for my Labor (Perm) on Apr 21, 2008.
Got Approved on June 24, 2008.


1. Do I Eligible for Premium Processing of I-140?
2. If iam not eligible for Premium Processing, still do I eligible for 8th year extension based on my Labor applied on Apr21, 2008 (365 days before my 7th year H1B expiry)? Even when company A withdraws my MTR.

Please advice.

I think in your second case (cpy B), you can apply for PP. As long as your first app does not impact ability to apply, you should be eligible. Check with your lawyer.

The U.S. Citizenship and Immigration Services (USCIS) recently expanded the reinstatement of premium processing for I-140 petitions. This is a subtle change, still limiting I-140 premium processing to a small group of cases for which the I-140 approval is needed in order to obtain eligibility for additional H1B time. The change was effective March 2, 2009. The expansion includes individuals who have already reached the end of their six years in H1B status, who would be eligible for additional time upon the approval of the I-140 petition. I am sorry if I am not reading this right, but does it mean that a person on his 7th year H-1B can apply for pp? I am currently on 7nth year, and renewal is due before september. My I 140 is pending since July 2007, and no LUDs or updates. Am I elligible?

I would like to know the answer too, but my research tells me that only in few cases, you can use I-140 premium processing. In my case, I am not able to use it as my H1B started on Oct 07 (it is not expiring anytime soon).
