This pertains to my son whose birthday is August 1990 (so he turns 21 this august).

My approved I-140 EB2-I petition has a priority date of October 2007- total time application was pending = 4 months

So does CSPA protect him till December 2011? If my PD becomes current in say Nov 2011, can he file as my dependent?

I understand that doesn't look very likely at this point, so my other question is, can he retain the priority date of October 2007 when I file an I-130 for him? Or will it be a whole new PD?

Thank you

When you filed I 485 in 2007 - did you talk to attorney of adding at that time if you can add him for filing 485.

As per dates you mentioned with grace period of pending I 140 dates you could have filed in 2007 itself for your son also right?

I filed for my child at 17 during 2007 along with mine.

Not sure if I am understanding correctly your question or not?

I wasn't able to file in July 2007 when all dates became current because my application was pending at that point, my priority date is october 2007. So we have not filed any I-485's yet.
