FYI

Harrisburg PENNDOT explicitly stated that unless one has a valid visa for 1 year or more or has a Greencard; PA law does not allow them to renew a driver’s license.

I just got a confirmation on this.

Has anyone renewed their license using 485 receipt/EAD/approved I140 in PA?

Yes, we've renewed our DL in PA. They said the same thing but they also said
if you get a letter from the Employer that you've a project in PA and You'll be working in PA and with them(Employer) for One year they'll renew your license with EAD.

i think you are wrong , as they have to issue you licence till the date of expiry of your visa, Please go to another DL center and confirm.

Did they refuse you in black and white?

It appears DL laws are getting changed in every state to make life hell for EAD users. We have a similar (actually worser for now) situation in Michigan.

A letter from my employer stating a future work assignment in PA worked for me 6 months back. They gave me a license for 3 years, even though my H1 is NOT valid at that time. Even I know, few others did the same and got their licenses .... This worked even for H4 candidates tooo !!!!!

I went to Bensalem, PA DMV center ......

This is how it worked for us, we got a letter from the Employer that I've a project in PA for a long term and also I'll be with the Employer for atleast 1 Yr, and showed them my EAD. They issued DL till my EAD expiration date(ie.. for one yr).

I did have that problem when I was on F1. I got my learner's permit by going to a different DMV. So go to a different DMV.

Coming to a person with EAD, I did renew my license with any problem. He didn't even ask any documetns. Go online to fill out the license renewal form and they will send you a letter to take to the nearest DMV. You should get the renewal license in 5 mins. Maybe this procedure will work only for renewals

I do not know whether they changed the rule very recently or not. However, last year when I was on a TN-1 visa (issued for 1 year), they gave me a PA license even though it was for less than a year by the time I went to the DMV. I live in PA.

From the document posted by green_world, the rules say explicitly that for an H1B, a letter of employment would be enough and for adjustment of status, expiration date of the license would be 1 year after the date of application. Nowhere does it say that the expiration of license has anything to do with expiration date of visa or EAD, unlike for F1 visa where it clearly states that duration of the license will be the same as that of the visa.

In PA, among DMV officers most of them know only I-94. So they look for the expire date in I-94 and if it is valid more than a year then they extend the license. Otherwise they simply say no to it.

Could someone pls help me on this..my situation is slightly different.
We r out of state and my hubby is planning to join a company in trenton,NJ using EAD and we are planning to live in Philadelphia,PA.
EAD expires in Sept 08.
Some of u r suggesting to get a letter from employer stating that work place is in PA to get the license. What do u do when the work place is NJ and residence is PA??
Also we r planning to buy a new car...is it better to buy it in the current state we live in and register it in PA or come to PA and buy it there??
Pls advise asap.

You have to register your car where you live, namely PA. That's not optional. You can buy it anywhere. You will also need a PA driving license.

No You cannot renew it online. You must appear in person.

You can not renew online. If you still try to renew it online, you will get a message on the browser asking you to go to nearest DMV..

I have lived in PA for about 9 years now. I did renew my license online and I did'nt have a problem. When I went to receive my photo id card, all they ask is your old license and confirmation of social security. It could be that I got my new license before 2000 and they didnt have any issue regarding visa then. It all started after 911. I know I might have a problem if I move out of state.

Getting a valid driver's license requires 2 proofs of residency to be shown..one can be the apartment lease agreement...second one should be utility bill...which will come only end of the month i.e after 30 days!
What do ppl do in this case? Any suggestions?

It doesn't need to be an utility bill. It can be any letter (or Fedex envelop)addressed to you. Credit card change of address notification receipt will work too.
I moved to PA from VA and didn't change my car registration and DL for nearly six months due to hectic travel schedule. When I finally went to change the registration no one asked me any questions.

Why do you think it takes 1-2 months? I got mine the same day. There is a document in the pa dmv website that tells you what documents you need to take with you to present to the DMV officer. If you have all the documents they will give you your license the same day. At least that was my experience.

If you are merely transferring your license from another state, it won't take 1-2 months, you'll get it the same day. Perhaps they were thinking that you are starting from scratch with the learner's permit and everything.

Why do you think it takes 1-2 months? I got mine the same day. There is a document in the pa dmv website that tells you what documents you need to take with you to present to the DMV officer. If you have all the documents they will give you your license the same day. At least that was my experience.


The reason it will take atleast a month is that we should give them 2 proofs of residency which in my case is lease agreement and utility bill. We will have the lease agreement but the utility bill will come only after one month.

Ya..the actual license will come in a day but to apply for it we will need a month's time for reasons mentioned above.

Actually i recently moved from CA to PA, My wife started working in philli last year, I just tried my luck and took only the lease agreement with me..All the bills are currently in my wife's name. They just checked my I-94, Employment letter and my CA license and said they don't need the residency proof. My guess is they must have my wife's DL details on the same address. So i was given a temp license the same day itself and 2/3 days later i got the permanent license in mail. In CA since my license was created in 2001 i never had any license problems, Every 3 yrs it would just come in the post ..From now on i think i will have to do the license dance every time my I-94 expires. My EAD expires on Oct 08 and H1b i-94 from the same company expires in Feb 2010. So i used my H1b I-194 and got the license till Feb 2010. The people at the DMV were very helpful and jovial :). I went to the Bortondale, PA 19063 DMV.

In PA , Once you filed I-485 anyone would be eligible for a 4 yr License according to one DMV officer in Pitstburgh,PA. Not sure this Rule applies all over PA State.

Thanks for the info.. I guess my situation is different since both I94 and H1B r expired and we will be using EAD with the new company. But I was told that we will get license till EAD expiry date and we have to renew every yr till we get GC.

For my wife, we were able to get the license extended for one year by showing the 485 receipt only. In place of EAD we showed her Passport. (We did not apply for EAD. Her H1-B extension is in process). Location: Malvern, PA

Hi,
I received a letter from Harrisburg that says that I should go to the DMV and provide my updated immigration documents, as my expiration date is near(my license expires in January).

Today I went to Bridgeville, PA, and they said they have to send copy of all my documents(I-485 receipt, I-94, EAD, Passport) to Harrisburg for verification.

They said that Harrisburg will call immigration, and then contact me in 2 weeks.

Did anyone else face this issue? What am I supposed to do?

I received similar letter for my wife...We have not yet gone to DMV with documents...
Letter says, If you wish to extend the your DMV then you should visit nearest DMV center along with documents which shows your status or expiration date is changed....
