Hi,
My current employer is not willing to give me a copy of approved I-140. I have the LIN number of I-140. Is possible to request a copy from USCIS.
If so could anybody point me to link where I can apply for a copy of I-140.

Thanks,
Parthu

Lawyer is not giving the copy. He said that it is company policy not to give the I-140 copy to the employee.

If you are still extending H1B, usually they (law firm) would send a copy along with your H1B approval doc's for your 3 year extension. I got my I140 copy this way. Typically employers don't send I140 copy.

Thanks for the info. I don't see I-140 copy in the approved papers. But I see the LIN number of I-140 on one of the papers.

One way you could ask your employer is if you are planning on going for stamping you need I140 copy because during visa interview , consulate might ask you to show proof that how you received 3 year extension ... just a thought..

Ya, I will give a try. Still I have a lin number, I can request a copy from USCIS. But I am not sure how long it is going to take.

As far as my knowledge goes , you cannot have right to own a copy from USCIS on I140 because it is company related (I 140). you have every right on I 485 (its individual).

@ Parthu,

Employers would not share 140 copy, most of the time. But, when I applied for FOIA, I added 140 copy also in request and it took nearly 10 months to get all the copies of labor, 140, LCA's etc.

But, good thing I got it. I would recommend you to file a FOIA (freedom of Information Act) and you would also get them.

Google on how to apply for FOIA.

Hope this helps.
