USCIS has launched a new, comprehensive effort to review all Agency policies with the engaged participation of both the workforce and the public. This effort will help us ensure that USCIS policy serves our fundamental mission and reflects our core values of consistency, integrity, transparency, and efficiency.

This is what I wrote in comments section:

With EB3 India backlogged with nearly 25 years of wait it is just illogical for USCIS to expect for the applicants to be in the same or similar profession for same time. An applicant who has filed for AOS and has a priority date that is more than 5 years old should be allowed to change the jobs freely. While it is true that he started GC for specific profession with technology and professions changing it is very hard to maintain the same. The 5 year limit maintains the spirit of the law while making the rule slightly more bearable for the applicant.

Counting the family members as part of EB visa count: The law does not make the distinction on whether the family members of a EB applicant should be counted in EB category or not. With the current practice of counting dependents as part of EB visa limit the wait times for most EB categories are unbearable, a simple change in approach at USCIS can bring a lot of relief to the applicants.

I put the below comments.

EB3-India category is stuck at 2001 for the last 10 years. Earlier USCIS has allocated spill over visas from EB1 to EB2 and EB3 equally. Now ALL spill over visas are allocated to EB2. Please review this policy. Spill over visas should be equally allocated across EB2 and EB3 categories.

In light of the 10 year waiting period for Employment based Green cards, Travel document and Employment authorization document should be valid for 5 years at a minimum.

Priority X:
Background: System needs to be integrated for United States Citizenship and Immigration Services (hereafter referred as USCIS) to approve/process all the application based on Priority Date. This will require VISA demand to be sent to Department of State (hereafter referred as DOS).
Dependency: DOS is dependent upon USCIS for providing accurate data every month to move dates by VISA bulletin.
Technology requirement: USCIS Primary Application need to communicate in real-time/near real-time with IVAMS (Immigrant Visa Allocation Management System)
Current Status: KPMG audit (http://www.dhs.gov/xoig/assets/mgmtrpts/OIG_10-59_Feb10.pdf) recommendation mentioned on page 12/17 - 4. Track all pending applications within one system or in a series of systems that are integrated.
Question: What is the Implementation date for this recommendation?

Priority X:
Background: CISOMB Annual Report Recommendation 2007-02 (http://www.uscis.gov/USCIS/Resources/Ombudsman%20Liaison/cisomb-2009-response.pdf): Pending Cases – “Provide a clearer picture of the current backlog by providing information on the number of pending cases by form type with receipts that are: (1) less than 90 days; (2) less than 180 days; (3) less than 1 year; (4) less than 2 years; (5) less than 3 years; (6) less than 4 years; and (7) greater than 4 years.”

USCIS response: on February 13, 2008 - upon the launch of USCIS’s new Web site, customers will be able to identify their place in the process as well as the total number of applications pending at that same point.

Current Status: Data on USCIS dashboard (USCIS: National Processing Volumes and Trends (http://dashboard.uscis.gov/)) are 3-4 months old and nowhere near real-time or near real time. From Raw Data customer is not able to indentify there place in process.

Recommendation:
1. National Trend Raw data should include unique case Number / Application with unique information for case.
For e.g.
For I-140 Application - When we download national Volume Raw data, we see Cumulative number only. - Raw data should be Multiple row/Column containing all the Field offices + Visa centers + Form I140 data such as, Application receipt number, Classification, Certification, Priority date, Consulate, A number, Country of nationality, Response to Processing information 1,
For I-485 Application - When we download national Volume Raw data, We see Cumulative number only - This Raw data should be include –Application receipt number, A number, Answer to - part -2 Application Type (As this will determine whether Application is Employment based or any other type), Nationality, Country of Chargeability, Category (EB1,2,3..),Priority date,
2. Modification of My case Status to include “VISA request to DOS” between “Request for Evidence” & “Testing and Interview”



Priority X:
Background: KPMG’s audit report* mentions that Pending cases includes I-485 records of ‘relief for deportation’. Immigrant community is worried that this error might have percolated into Allocating VISA to “‘relief for deportation’ from incorrect category.

Current status: Unknown to non-immigrant community.

Recommendation: USCIS can initiate self Audit of last 2 years of Employment based approved applications.


Priority X:
Background: USCIS published Employment pending inventory reports.
Recommendations:
In conjunction with Inventory report USCIS can publish,
1.0) Where we can find USCIS published monthly I485 application rejection report.
2.0) Where we can find USCIS published monthly I485 application withdrawal report (due to PD porting to other categories or Employer withdrawal or any other reasons.)
3.0) where we can find USCIS published monthly VISA return (unused) to DOS report, as per Operation of the Numerical Control Process all unused VISA’s need to be returned to DOS for reissuance.
4.0) Where we can find USCIS published monthly I485 VISA’s per category demand to DOS.


Please go ahead and post your questions in the survey. This will provide an additional avenue to communicate your concerns and questions. VBkris I know maybe taking some info from it for the analysis document, but the scope of questions will be limited due to the agenda of the document. People who feel strongly about these questions should use the opportunity to ask them via this survey. Do write that you are a member of Immigration Voice so that it helps us in our meetings in future where we can discuss most common concerns of our members.

EAD without expiration date issued immediately after I-140 approval (no priority date BS!). This should be valid until GC is issued and preferably double up as travel document too (without AP BS!).

Organization: Immigration Voice (IV)

On EB Sheet - I put the following details in additional comments.

1) EB2 and EB3 India are highly retrogressed: It appears the wait time for getting a Employment based Green Card is anywhere from 7 to over 10 years time. This issue has to be resolved. A Recapture of all the unused EB Visa numbers can be a solution since that will drastically reduce the backlog.

2) The country cap should be removed since it does not make sense for an employment based quota. Neither H1B is based on country nor do the employers hire people based on country. Hence, the EB Green Cards quota tied to country of origin is not justified.

3) General Feedback: There is barely any customer service. We are paying a lot of money and it’s very difficult to track the status of the documents/applications submitted. If there is an error in processing on any of the applications, there is no ownership of this from USCIS. The whole burden of fixing the error by USCIS is pushed onto the applicant. We need accountability and decent customer service for the money we are paying for all the forms (EAD - I765 renewal, I-129 H1B renewal etc)

Your lawyers know a lot and can help us.
Can you ask them to also help fix immigration system for everyone. We are waiting for so many years.

In my opinion, Surveys mostly work on the principle of common denominator. So if a lot of people are saying the similar thing then it gets a higher priority. So if we use the word "Fix Legal Immigration" and say the things like "These are the people who follow the Law" then our comments can get somewhat higher priority.

Just my opinion.
