Congrats to all EB2- folks till PD Feb 2005

Really EB3-India deserves a move ahead to.. for the past 3 years after the 2007 July Fiasco there was no valid movement on EB3-India category.

How long people can wait like this???

Until we retire I think ..after that they will give us our Employment based GC :mad:

They are planning to increase the retirement age; since they do not have money to pay for the SSN benefits.


Until we retire I think ..after that they will give us our Employment based GC :mad:

I don't think EB3/I will get any spill over, even if EB2/I is current, it will use all the quota rest of our lifes.

maybe they should address the backlogs starting with oldest PD first, irrespective of categories with the spillover numbers...doesn't matter whether it is china/mexico/india/eb1/eb2/eb3 etc.

this is controversial though...I can already see EB2s denying & downplaying this thought & EB3s cheering.

anyway, EB2s do not worry. The law is not going to change overnight & if only thoughts can become law immediately, we all might have green cards by now. so take it easy.

What will they increase it to?

New Retirement Age: 110 years or till you die which ever comes first.

How about printing some more money while you are at it and paying people back who actually paid into the system for a change.

Me neither. My take is that they giving out a lots of numbers to available countries that are oversubscribed first. So there are many China, India and Phillipines numbers. Once they exhaust those countries limits (about 3k per country per year), the are going to move ROW Eb3 and move it a lot. I think in April the eb-3 ROW will move a lot. Let's wait and see.

I agree that it would be better to have more movement, but it is positive movement (gets closer to caught up, as it's more than one month).

It's also the last month of the quarter, and people like Ron say that the big movement will come for April visa bulletin...

We have seen worst when the dates moves backwards all the way to 2000 and start the slow crawl back forward so any small forward movement is sign to cheer since we are doing nothing in terms of lobbying or rallies to put our case.

but i think march 05 will be a killer for Eb2(I) movement. Once that hump is cleared..its will zip past in to first qtr of 06..

If they clarify on how/when the spillovers will occur...we can get a much clearer pic..

but its still good news..overall...

This PDF shows about 20,000 EB3-I cases. Is there any place where they show the PD split of these 20,000 cases.

very true that they do not have ( for sure will not have) money to continue pay SSN benefits.
may be sometime in the near future US govt will take a decision to mandatory retirement age of say 75.

There are lot of cases of EB3 India at consular processing with PD before April 2001, which are not count in the USCIS published inventory. These are all 245(i) cases. I wrote earlier in details about this issue. Thousands of Indian illegals successfully did 245(i) Normally illegal person is coming alone. After their green card approve, they files I 824 "Follow to join family members" for their spouse and kids. Priority Dates of these cases would be the PD of principle applicant (all PDs are prior to April 2001). I know at least three persons' family got green card with CP route recently.

EB3 is screwed up for years and years - I was in EB3 too but changed my jobs and applied in EB2. my feeling is USCIS will try to waste visas and at same time move dates a lot in the final months - this will allow more people to file 485 - which means more $$$ - this will allow them to cry about budget shortfalls too - since they can say we could not process cases due to less staff

You are right . Because illegal presence they will be subjected to statuary bar. But if the family members were not present illegally in US they can go for CP. Many of this guys came alone here and applying for family now.

o.k..that sort of makes sense but I would hope that 245i is all done ..because the family members would have had their GC's by now ..if not, then eb3 is screwed for years ..I wonder why anyone would even file in eb3 ..I guess too extend as long as they can ...

I Understand, it will be difficult to digest, but if it is any solace..

You have actually missed it by two days.

As per the Bulletin it is always..

"Only applicants who have a priority date earlier than the cut-off date may be allotted a number... "

So i.e. anyone in Jan 05 got current, but none in Feb 05.

Many folks think that the date on bulletin is current, but actually it is only till the date prior to the one printed in the bulletin. In this case; anyone till and including Jan 31st 2005 is current.

PD dates in VB are always either 1st, 8th, 15th, or 22nd day of a month. So any forward movement of PDs in VB should make you current.

What is taking so long for DOL to publish 2009 PERM Data. In past years they always published it by end of JAN.

I looked at DOL's 2008 PERM data and found the below counts.

Certified = 21092
certified Expired = 28113
Withdrawn = 2063
Denied = 10729

Does anyone know what exactly means "Certified Expired" means? If those are the number of PERM labors that DOL approved and employers let those expire without filing 140, then only 21092 PERMs were approved in 2008.

It means the person did not file I-140 in 180 days, hence underlying labor certification is void.

I am a novice here. Just curious to know.

If Certified-Expired are excluded from demand, only 21092 PERMs were added to the demand in 2008 itself. Out of this 21092 PERMs 8407 PERM were from India/China and those candidates could not have filed for 485 because of retrogression. So the actual number of PERMs that would have made to 485 should be approx 12685 (21092-8407 = 12685). This will lead to approx 31713 GC visa number consumption. What happened to 108K visas?

I sorted on decision date and everything before 4/7/2008 shows as certified-expired. Everything from 4/7/2008 shows up as certified. so we really don't know how many PERMs actually made up to 140 filing.

As per GC_Demand, that's is not the case.

So we have 32k ROW application last year out of which approx 60% EB2. Last year EB2 row visa count was 32K. So that's matches the number there.

To answer your question . EB1 don't need PERM(40K gone)+32K EB2+ 40K Eb3+EB4+EB5=140K..

I think for most of our analysis, we need to assume that Most PERMS will lead to
I140 stage. It is very rare that it doesn't happen. Especially newer ones after I140 premium processing is established.

Spillover will occur in the last quarter, so the most interesting VB is going to be the July one.

Technically, USCIS needs to follow the law. it is not a private company to change strategy to improve its bottom line.

With USCIS claiming pre-adjudication of several cases, they should have a better control over the visa demand. So the possibility of them opening the gate for more applications and moving the dates back in future months should not happen.

Around 10:30 PM I checked my mail and got the following. I could not believe my eyes.

On March 1, 2010, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283

This is TSC

Case details:
1. Labor from DBC (Dallas Backlog center)
2. Did AC21 with H1 Transfer (used attorney and it did help)
3. Got RFE last year (used attorney and it did help)
4. Did not got FP for long time and did lots of Service Request and finally in one Infopass one officer helped us out and gave appointment for FP
5. Yesterday on Mar 01 opened SR to find out details about case and I have been told it is Pre_Adj
6. For Today Mar 02 took infopass and cancelled it as I got CPO mail

Total journey for GC 5 Yrs plus
Total Time in US 9 Plus yrs
Change 3 Employers so far

so they are working hard (Texas )

Did any one interfile Eb3 -> EB2 recently ? with a PD before Feb 01' 2005 ? Any idea how much time its goin to take with both I 140 Approved Different Employers and a PD of May 2004 & Dec 2004 ?

I tried to some options and one time I gave up. But selected an option saying there is a problem with my case and when connected to the officer I slowly deviated and talked him about the case.

You will figure out once you have tried three to four times
